New government regulations on conditions for buying, selling, and renting social housing.

(Dan Tri Newspaper) - The government has revised and supplemented the income requirements for eligibility for social housing policies, as well as the procedures for selling, leasing, and renting social housing. The new regulations have now come into effect.

The government has issued Decree No. 54, amending and supplementing several articles of decrees in the fields of housing and real estate business. The decree takes effect from February 9th, and notably includes regulations on social housing.

Regarding eligibility for social housing support policies, Decree No. 54 amends and supplements existing regulations by expanding the criteria for determining whether a person does not own a house, including cases where there is no information about housing in the Certificate of Ownership and regardless of the time of application for purchasing or renting social housing. Simultaneously, the authority to certify eligibility is also broadened, assigning it to the agency authorized to issue Certificates of Ownership under land law.

The recently issued Government Decree also amends and supplements the income requirements for eligibility for social housing policies by transferring the authority to verify income from the commune-level People's Committee to the commune-level Police and adding a mechanism for income declaration, commitment, and post-audit.

The new regulations also clearly define the application for confirmation as a document proving eligibility for social housing policies. The income ceiling remains the same as before (no more than 15 million VND/month for single people; no more than 30 million VND/month for married couples).

Citizens are responsible for declaring and committing to providing information on their average monthly income. Commune-level police coordinate with relevant agencies in verifying and post-verifying citizens' average monthly income information in necessary cases.

In addition, Decree 54 amends and supplements the procedures for selling, leasing, and renting social housing built under projects and not using public investment capital. The amendments aim to expand and standardize the forms of information disclosure on the information system and database on housing and the real estate market, and diversify the methods of submitting applications (in person, online, via post, or through the agency or unit where the worker is employed).

At the same time, the Government also clearly stipulates the processing time for applications; the order of priority for eligible individuals, and how to handle situations where the number of eligible individuals exceeds the quota…

The decree clearly states that within 30 days of the project's commencement, the investor of a social housing construction project is responsible for providing relevant project information for public disclosure on the website of the Department of Construction and the People's Committee of the commune where the project is located.

This information should also be published at least once in a newspaper that serves as the official mouthpiece of the local government and posted on the developer's website (if any) or the developer's real estate exchange platform (if any) so that people are aware, can prepare their applications for social housing, and can monitor and supervise the process.

Based on the publicly available information about social housing projects, households and individuals in need of social housing submit applications to the project developer. Each household or individual wishing to purchase social housing is not allowed to register for social housing in multiple projects simultaneously.

Applications can be submitted in person, online, or via postal service, or to the agency, unit, or enterprise where the individual is employed for compilation and forwarding to the project investor.

The time for submitting and receiving applications is determined by the investor, but it must be at least 30 days from the start of application acceptance.

The new government regulations also allow developers to prioritize selling to eligible tenants who wish to purchase a home up to 10 years before the lease expires, a longer period than the previous regulation of 5 years.

In addition, the new regulations expand the option of reselling social housing to the National Housing Fund and add details on how to determine the selling price of social housing currently being rented out (including appraisal price, loan interest, depreciation, etc.).
