I graduated from the College of Fine Arts Education in 2010. After that, I was a contract art teacher at a secondary school, paying social insurance from September 2010 to September 2017. In February 2019, I graduated from university majoring in primary education and took the exam for primary school teachers. From April 2020, I was classified as a grade II primary school teacher, with a salary coefficient of 2.34.
On July 1, 2024, I was considered for the new Grade III primary school teacher position, with a salary coefficient of 3.00. Recently, when there was a promotion review for Grade II primary school teachers, I was told that I was not qualified because I had not held the position of Grade III primary school teacher for 9 years.
I would like to ask, is the time I worked as a contract teacher, paying social insurance from September 2010 to September 2017, considered as the equivalent time holding the title of primary school teacher grade III to be considered for promotion to grade II? Point d, Clause 1, Article 32 of Decree No. 115/2020/ND-CP, as amended and supplemented in Clause 16, Article 1 of Decree No. 85/2023/ND-CP, stipulates: In case a civil servant, before being recruited and accepted, has had a working period (not including the probationary period as prescribed in Clause 2, Article 21 of this Decree) in accordance with the provisions of law, has paid compulsory social insurance, works in a job position with requirements on appropriate professional qualifications and skills (if there is a non-continuous working period without receiving a one-time social insurance subsidy, it will be accumulated) and that time is calculated as the basis for salary classification in the current professional title, it will be considered equivalent to the current professional title rank.
At the same time, Point b, Clause 3 of Circular No. 05/2024/TT-BNV dated June 27, 2024 of the Minister of Home Affairs stipulates the standards and conditions for promotion to Grade II and Grade I for administrative officers, clerical officers, and archival officers; salary classification for those recruited and accepted as civil servants is prescribed as follows:
“In case the working time is subject to salary with compulsory social insurance payment in accordance with the provisions of law and is calculated to classify the salary into the rank of the appointed civil servant when recruiting and receiving as prescribed in this clause, the equivalent time holding the rank of the appointed civil servant is calculated from the date of having the same training level or having a higher training level than the training level required by the job position being recruited and received”.
According to your letter, the time working as a contract teacher of Fine Arts at a secondary school (college level, majoring in Fine Arts Pedagogy) is not determined to have the same level of training, professional and technical requirements as the position of a primary school teacher and is not counted as the basis for salary classification when appointed to the professional title of primary school teacher.
Therefore, the time you worked as a contract art teacher at a secondary school is not considered equivalent to the time you held the professional title of a grade III primary school teacher. The time you held the professional title of a grade III primary school teacher is determined from April 2020 when you were officially appointed to the professional title of a primary school teacher.
