According to Conclusion No. 1480/KL-STNMT signed by Mr. Nguyen Hue, Director of the Department of Natural Resources and Environment of Quang Binh province , the Department's inspection team pointed out a series of violations related to the above inspection content.
The delegation inspected 22 units, including 21 units with 25 projects leased land by the State.
Regarding land use progress, the inspection showed that 23/25 projects of 19 units did not use land for 12 consecutive months or the land use progress was 24 months behind schedule compared to the progress recorded in the investment project since the land was handed over on site. For example, Coco's Botique Hotel of Hoang Gia Phat Consulting and Investment Company Limited is 128 months behind schedule; Hung Phat Production and Trading Company Limited has 3 projects behind schedule, of which, Gia Ninh petrol station project is 80 months behind schedule...
The projects of 3 units include: The project to build a non-burnt brick factory in Thuan Duc commune of Cau 4 Brick and Tile Trading Joint Stock Company; the project to build an executive office and display interior products in Nam Ly ward of Khai Tin Investment Company Limited and the project to process finishing parts and display handicraft products in Quang Phu Industrial Cluster of Duc Loc General Joint Stock Company (both in Dong Hoi City), behind schedule without reason and owing land rent; the project investor did not come to work with the inspection team and there were no construction investment activities on the ground.
Pullman Quang Binh 5-star hotel project is 54 months behind schedule.
Regarding the inspection of financial obligations in land use, it was discovered that 7 projects were in debt for land rent; 5 projects were in debt for non- agricultural land use tax; 5 projects had not yet declared to pay non-agricultural land use tax; 23/25 projects had not declared and paid land rent due to slow progress, of which 2 units of the Provincial Tax Department had calculated the land rent payable due to slow progress in land use and had notified but the units had not paid.
Notably, in Bao Ninh commune, Dong Hoi city, there is the 5-star Pullman Quang Binh hotel project of Hanoi-Quang Binh Tourism Joint Stock Company, 54 months behind schedule, owing more than 5.7 billion VND in land rent and hundreds of millions of VND in non-agricultural land use tax; the Culinary Restaurant project of Phu Ninh Joint Stock Company, 82 months behind schedule, has not completed land use extension procedures, and has not paid investment deposit.
The Director of the Department of Natural Resources and Environment requested 16 units implementing 20 projects that are currently using land but have not yet put the land into use, using land behind schedule compared to the committed investment project due to force majeure reasons to accelerate the construction investment progress to put the project into operation; carry out procedures to request an extension of land use so that the competent authority can consider granting an extension according to regulations; commit to completing the project on schedule if the land use extension is granted. In case, if the land use extension expires but the project has not been completed, the Director of the Department of Natural Resources and Environment will prepare a report to the Provincial People's Committee to direct the handling of the termination of the investment project or the revocation of the investment license and land recovery according to regulations.
Based on the conclusions, the Director of the Department of Natural Resources and Environment also proposed that the Provincial People's Committee reclaim land for the project of the Finishing Processing and Display Area of Fine Art Products at Quang Phu Industrial Park (Dong Hoi City) of Duc Loc General Joint Stock Company with an area of 1,300m2.
At the same time, direct the Department of Planning and Investment to advise on terminating the investment project and revoking the investment certificate for 2 projects: Project to build a non-burnt brick factory of Cau 4 Brick and Tile Trading Joint Stock Company; Project to build an executive office and display interior products of Khai Tin Investment Company Limited, which received the transfer from H&T Architecture Company Limited.
Direct the Provincial Tax Department to urge and request units that still owe land rent to pay for the delayed period, and to commit to a specific roadmap on the time to pay the above financial obligations to the state budget; provide information on the implementation of financial obligations of units that still owe so that the Department of Natural Resources and Environment has a basis to submit to the Provincial People's Committee to handle cases of intentional debt of financial obligations after being leased land. Urge units that have not declared and paid non-agricultural land use tax to declare and pay non-agricultural land use tax in accordance with regulations.
