The Law amending and supplementing a number of articles of the Intellectual Property Law, which will take effect from April 1, 2026, was passed at the 10th session of the 15th National Assembly. The focus is on shifting from "copyright protection" to "proprietaryization, commercialization, and marketization" of intellectual property products. This is a breakthrough step to transform intellectual property into a new growth resource for the economy .
One of the new features of the law is that it allows for the valuation and research of mechanisms for commercializing intellectual property rights. Accordingly, products and projects that have been registered for protection can participate in buying and selling transactions on the market, especially in the context that most intellectual property currently exists in the form of digitized data.
Mr. Nguyen Huu Can, Acting Director of the National Institute of Intellectual Property, Ministry of Science and Technology, stated: "Currently, data has become a crucial resource, and big data can even be considered a national resource. By effectively exploiting this resource, we can form a data ecosystem, make good use of technical resources, and create significant value for science and technology."
The amended Intellectual Property Law also expands the scope of entities allowed to use publicly available data without author permission, including technology companies developing AI tools. However, according to experts, this needs to be accompanied by mechanisms to ensure a balance of interests among all parties.
Ms. Vu Thi Hai Yen, Deputy Head of the Department of Civil Law at Hanoi Law University, stated: "Without input data, AI will be worthless because it has no basis for learning and innovation. The quality of input data will directly determine the quality of the products created by AI."
To ensure the efficient functioning of the intellectual property market, the law also allows for comprehensive digital transformation in the intellectual property sector, including the establishment of intermediary trading platforms, which both facilitate transactions and enhance management.
Many argue that, in order to both unleash creativity and promote technological development, implementing guidelines need to design mechanisms that ensure a balance of interests between the State, businesses, and authors. Only then will intellectual property assets truly realize their value in the digital age.
