On the afternoon of November 14th, Deputy Minister of Justice Phan Chí Hiếu chaired a meeting of the Appraisal Council for the draft Resolution amending and supplementing several articles of Resolution No. 136/2024/QH15 of the National Assembly on the organization of urban government and piloting some specific mechanisms and policies for the development of Da Nang City (Resolution 136). Attending the meeting of the Appraisal Council was Vice Chairman of the People's Committee of Da Nang City, Trần Chí Cường.

After hearing the opinions at the meeting, Deputy Minister Phan Chi Hieu stated that the Council unanimously agreed on the necessity of issuing the Resolution for the reasons stated in the draft submission. The contents of the draft Resolution are consistent with the Party's policies and guidelines on the construction and development of Da Nang City.

Regarding constitutionality, the draft Resolution proposes expanding the cases in which the State can reclaim land. This is a sensitive and complex issue, directly related to the legitimate rights and interests of land users. Deputy Minister Phan Chí Hiếu requested that the drafting agency further clarify the addition of the aforementioned cases of land reclamation by the State.

Regarding the legality and consistency of the legal system, the draft Resolution contains some provisions that differ from current laws. Therefore, it is requested that the drafting agency carefully review the draft to ensure that the amendments and additions are truly unique and groundbreaking policies within the authority of the National Assembly that are not yet regulated by current laws; and that they do not re-establish existing provisions…

According to the Deputy Minister of Justice, the draft Resolution's content is consistent with international treaties to which Vietnam is a signatory; ensuring national security and defense... The Council unanimously agreed that the dossier is eligible to be submitted to the Government after revisions and additions to some content as requested by the Appraisal Council.
