Removing difficulties for transport business vehicle owners who have not changed to yellow license plates

According to statistics from the Ministry of Public Security , there are currently about 15,000 vehicles that have not completed the procedures to change vehicle registration.

Implementing the direction of Deputy Prime Minister Nguyen Hoa Binh regarding the resolution of the proposal of the Vietnam Automobile Transport Association on removing difficulties related to the registration of transport business vehicles with discrepancies between the license plate background color information and the actual vehicle, on the morning of July 10, the Ministry of Construction held a meeting on this content.

Speaking at the meeting, Mr. Nguyen Cong Hung, Vice President of the Vietnam Automobile Transport Association, proposed allowing transport vehicles that have not changed the license plate background color information on their vehicle registration to continue to be inspected until June 30, 2026.

The reason is that Circular 12/2020/TT-BCA of the Ministry of Public Security stipulates that transport businesses must change their license plates from white to yellow, and at the same time, change the information on the vehicle registration from T to V, with the implementation period until the end of 2021.

However, during this period and until June 2022, localities are still implementing social distancing to prevent the COVID-19 epidemic, leading to some businesses not being able to update the regulations and not being able to implement them in time. On the other hand, due to the impact of the epidemic as well as market fluctuations, transportation businesses are having difficulty restructuring their debts with banks, and some banks where businesses mortgage their vehicle registrations are under investigation by the police, leading to businesses not being able to borrow vehicle registration papers from banks to change information.

There are about 15,000 vehicles that have not changed their vehicle registration.

Regarding this issue, Mr. Nguyen To An, Deputy Director of the Vietnam Register, said that the license plate with a yellow or white background is used to distinguish whether the vehicle is used for business transportation or not, which determines the vehicle's inspection cycle. Because business transportation vehicles have a high operating frequency, they are less concerned with maintenance than private vehicles. Therefore, the inspection cycle is lower, the inspection requires higher requirements, thereby ensuring the technical safety quality of the vehicle and ensuring traffic safety.

The representative of the Traffic Police Department also informed that Circular 58/2020/TT-BCA of the Ministry of Public Security, effective from August 1, 2020, stipulates that by December 31, 2021, transport business vehicles must complete procedures to change license plates and vehicle registration certificates. After that date, if not done, they will be subject to administrative penalties. To facilitate businesses, the license plate change is simplified by only changing the license plate background color from white to yellow, and the letter T on the vehicle registration is changed to the letter V.

According to statistics from the Ministry of Public Security, there are currently about 15,000 vehicles that have not completed the procedures to change vehicle registration.

The representative of the State Bank of Vietnam also said that, up to now, they have not received any documents detailing the specific number of vehicles that are having trouble withdrawing/borrowing vehicle registration certificates. In addition, there are many reasons why businesses have difficulty withdrawing/borrowing vehicle registrations from credit institutions, however, they are mainly related to the reputation of the business in borrowing and repaying debts with the bank.

The Ministry of Justice believes that it is necessary to clearly identify the difficulties and shortcomings of the problem, whether due to the law or due to implementation, and to clarify how many transport business vehicles are mortgaged to banks but are stuck and cannot borrow to change vehicle registration.

A review of legal regulations shows that the Law on Road Traffic Safety and Order stipulates that inspection facilities refuse to inspect violating vehicles when the vehicle owner has not yet completed the request of the competent state agency to resolve administrative violations in the field of traffic safety and order. Meanwhile, Decree 166/2024/ND-CP stipulates that inspection facilities that do not inspect vehicles are warned in case there is a discrepancy between the vehicle registration certificate and the actual vehicle when carrying out inspection procedures.

The Ministry of Justice has asked the Vietnam Automobile Transport Association to represent the agreement with the State Bank of Vietnam to direct credit institutions to support businesses. Because businesses need to continue doing business, banks can collect debts.

Accurate statistics of the number of vehicles having problems

In the spirit of creating favorable conditions for transport enterprises while still ensuring compliance with legal regulations, Deputy Minister of Construction Le Anh Tuan requested the Vietnam Automobile Transport Association to accurately count the number and reasons why transport vehicles have changed to yellow license plates but have not changed the information on the vehicle registration, leading to rejection when going for inspection. From there, classify and propose specific solutions for each type of case, and set a certain implementation time.

"In case it is necessary to withdraw the mortgaged vehicle registration certificate from the bank to exchange for a new vehicle registration certificate, the vehicle owner and the representative of the credit institution can go to the commune-level police station together to sign a confirmation to get a new certificate. When a new vehicle registration is available, a copy can be printed and the original certified at the commune-level police station to hand over to the vehicle owner. At the same time, the bank representative will retain the original new vehicle registration certificate," the Deputy Minister suggested.

To support the Vietnam Automobile Transport Association in counting vehicles that have not changed their vehicle registration, the Ministry of Construction will send a document to the Department of Construction of localities to check the number of vehicles with transport business registration badges, and then coordinate propaganda to transport businesses. Any unit that has not changed its vehicle registration needs to notify the local transport association for statistical purposes.

The Ministry of Justice continues to research and issue documents clarifying relevant provisions in legal documents, and at the same time, issue specific instructions as a basis for implementation by all parties.

On the side of the State Bank, the Deputy Minister proposed to have more instructions for credit institutions to support businesses in borrowing mortgaged vehicle registration certificates to change to new vehicle registration, suitable for the actual vehicle to facilitate vehicle inspection.

"Transportation businesses need to strictly implement regulations on vehicle identification, thereby standardizing databases, linking and sharing data among relevant agencies to serve State management work," Deputy Minister Le Anh Tuan emphasized.

Previously, on June 23, the Government Office issued a document conveying the direction of Permanent Deputy Prime Minister Nguyen Hoa Binh regarding the proposal of the Vietnam Automobile Transport Association regarding the shortcomings in the inspection of vehicles that have not changed their registration papers to match the new license plate.

In particular, the directive needs to have a comprehensive and fundamental solution to handle the issue thoroughly. The Ministry of Construction is assigned to preside over and coordinate with the Ministry of Public Security and relevant agencies to promptly report to the Prime Minister on matters beyond its authority.

According to the Vietnam Automobile Transportation Association, there are currently about 1 million commercial transport vehicles nationwide that have switched to using yellow license plates. However, most of them have not completed the procedure to change their vehicle registration to match the new license plates - a mandatory condition for inspection, according to Decree 166/2024.

The main reason is that the vehicle registration is being mortgaged at the bank – considered as collateral in the loan application. Therefore, the vehicle owner has many difficulties in withdrawing or borrowing the old registration to carry out the procedure of changing to a new one.

Faced with this situation, the Vietnam Automobile Transport Association recommends that the Government should have flexible solutions and a suitable roadmap to support businesses and vehicle owners to remove obstacles. The handling must ensure compliance with the law while avoiding disruption to the chain of business operations and vehicle inspection.
