Removing obstacles in land procedures when operating a two-level government

Khanh Hoa province, when operating a two-level government apparatus, faces many difficulties in state management of land, especially at the grassroots level. From this reality, the Department of Agriculture and Environment of Khanh Hoa has gradually sought solutions to remove obstacles in the fields of land, agriculture and environment.

This also aims to improve management capacity and unify implementation procedures for cadres, civil servants, and public employees at commune, ward, and special zone levels in the province.

The Public Administration Service Center of Nam Ninh Hoa commune receives dozens of documents in the field of natural resources and environment every day.

According to Mr. Nguyen Dinh Su, Head of the Economic Department of Nam Ninh Hoa Commune, the process of implementing land procedures has just been issued by the province recently, so there are no specific instructions. The implementation of related administrative procedures still faces some obstacles, especially when commune-level cadastral officers access and process land records.

At the recent regular November meeting of the Khanh Hoa Provincial People's Committee, many localities frankly raised difficulties and problems that needed to be resolved. Tan Dinh, Thuan Nam, and Phuoc Ha communes reported that data between the public administration software and the VBDLIS land management system were not synchronized, and technical errors often occurred, causing delays in processing records.

People's Committees of communes such as My Son and Thuan Bac said that the infrastructure is still lacking, the Internet connection is weak, the E-Office system is not operating stably, and the staff is still confused when performing their duties. Some localities lack specialized human resources in land, accounting, and information technology, affecting the progress and quality of service to the people.

Mr. Nguyen Trong Bao, Deputy Head of the Land Management Department (Department of Agriculture and Environment of Khanh Hoa province) said that local authorities at the commune level are currently assigned to carry out many administrative procedures related to the fields of land, natural resources and environment. Meanwhile, the number of specialized staff at the grassroots level is still lacking, professional skills are not uniform, and the land management software system is not operating uniformly. This is the main reason why the reception, appraisal of documents and issuance of land use right certificates are still slow, especially in newly merged communes.

The 2024 Land Law has many new regulations on the rights and obligations of land users, land recovery, compensation, resettlement support, planning announcement, land price list and agricultural land transfer. Many localities in Khanh Hoa province believe that strong decentralization to the commune level while technical infrastructure and human resources are not yet synchronized can easily lead to overload, especially in the early stages of operating the two-level government model. Therefore, it is necessary to soon complete the coordination mechanism between specialized departments of the Department of Agriculture and Environment and the grassroots level...

According to Mr. Nguyen Ngoc Tuyen, Deputy Director of the Department of Agriculture and Environment of Khanh Hoa province, after the reorganization of administrative units, many communes and wards have changed their boundaries, land records and land data have not been synchronized. The Department of Agriculture and Environment has directed the Land Registration Office to coordinate with localities to review, update information and provide instructions on using the VBDLIS Land Management System to unify management throughout the province. This is a key solution to improve the efficiency of land management and reduce the time to handle administrative procedures. Along with technical solutions, the team of commune-level officials and civil servants also proactively research and apply legal regulations to local practices appropriately.

By finding solutions to remove obstacles in implementing procedures in the field of natural resources and environment, Khanh Hoa province aims to build a service-oriented administration.
