From 2026, information regarding land use rights mortgages will no longer be directly recorded on the Land Use Right Certificate (commonly known as the Red Book) but will be completely updated on the land database system. This is the central content of Official Letter No. 02/CĐK&BTNN-QLĐKBPBĐ issued by the Department of Registration of Secured Transactions and State Compensation, aiming to accelerate the digitalization and modernization of state management.
New mortgage information management mechanism
According to the new regulations, the registration authority will cease directly verifying mortgage details on the pages of the Land Use Right Certificate as in the traditional method. Instead, all data related to the registration of mortgages on land use rights and assets attached to the land will be stored and updated synchronously on the land database system as prescribed by law.

This change is expected to help ensure consistency, transparency, and shorten the time it takes for relevant parties to retrieve information in civil and economic transactions. Digitization also helps to reduce the risks of damage or errors in information inherent in manual recording on paper.
Handling cases of changes and deletions of mortgage registrations.
For land use certificates that recorded mortgage information before the new regulations came into effect, the process for handling requests to change or delete mortgage registration will be carried out in two steps. Specifically, if the old mortgage information has already been recorded on the certificate, the competent authority will update the deletion information in the land database and simultaneously confirm the deletion directly on the certificate.
Finalize the legal framework and implementation roadmap.
Currently, the Ministry of Justice , in coordination with the Ministry of Agriculture and Environment, is reviewing, amending, and supplementing several relevant provisions in Government Decree No. 99/2022/ND-CP dated November 30, 2022, on the registration of security measures. This adjustment aims to ensure compatibility and consistency with the provisions of National Assembly Resolution No. 254/2025/QH15.

While awaiting the official promulgation of the amended decree, the use of forms, registration dossier preparation, and certification of content on the Request Form will continue to be implemented according to the current regulations in Decree No. 99/2022/ND-CP. The Department of Registration of Secured Transactions and State Compensation has requested the Land Registration Offices under the Departments of Agriculture and Environment of provinces and cities to uniformly implement these provisions.
