Continuing the ninth session, on the afternoon of May 17, National Assembly deputies discussed in groups the draft Law amending and supplementing a number of articles of the Law on Vietnamese Nationality; the draft Law on State Budget (amended); the draft Law amending and supplementing a number of articles of the Law on Bidding; the Law on Investment under the public-private partnership model; the Customs Law; the Law on Export Tax and Import Tax; the Investment Law; the Law on Public Investment; and the Law on Management and Use of Public Assets.

Protection of citizens in case of multiple nationality
Discussing in groups, Senior Lieutenant General Tran Quoc To, Permanent Deputy Minister of Public Security (Bac Ninh Delegation) emphasized the urgency of amending the Law on Vietnamese Nationality. In particular, it is necessary to focus on amending regulations related to acquiring, renouncing, and returning to nationality and the legal consequences that arise.
Senior Lieutenant General Tran Quoc To suggested that it is necessary to supplement detailed assessments on the compatibility and consistency of regulations on principles of entry, exit and residence of foreigners in Vietnam. On the other hand, it is necessary to clearly stipulate basic contents related to determining the obligations of Vietnamese citizens when simultaneously holding foreign nationality.
In addition, the drafting agency researched and supplemented regulations on mechanisms to resolve arising issues that negatively impact national security protection, citizen management, legal conflicts, and handling of violations against Vietnamese citizens who also have foreign nationality.

According to delegate Tran Thi Nhi Ha (Hanoi Delegation), amending the Law on Vietnamese Nationality is an important step to "untie" the legal aspect, so that Vietnamese people, whether living in the country or settling down and working abroad, can join hands to contribute, unite, and join forces to bring their homeland - their country into the era of national development.
Regarding allowing people applying for Vietnamese nationality to retain their foreign nationality, delegates said that recognizing the principle of multiple nationality is a step forward in line with the trend of international integration and legal practices of many developed countries.
However, the draft currently lacks a very important provision on citizen protection in cases of multiple nationality. International practice has recorded many cases of diplomatic conflicts arising when a citizen with multiple nationalities encounters legal problems in a third country - at this time, many countries declare the right to protection, or no country stands up to protect because the "effective" nationality at that time cannot be determined.
“The draft needs to add principles on determining effective nationality in cases of multiple nationality, as a basis for Vietnam to exercise its rights and obligations to protect citizens when they live, work or face legal risks abroad,” Ms. Tran Thi Nhi Ha suggested.
Mechanism for Hanoi to create more resources for development
Discussing in groups, delegate Hoang Van Cuong (Hanoi delegation) was interested in the draft Law on State Budget (amended). The delegate agreed with the review report with the desire to strengthen the role of localities in self-reliance in creating their own resources, not relying on the central budget.

For Hanoi, there is a revised Law on the Capital City in 2024 with many mechanisms and policies to have more resources for development. The revised Law on the Capital City clearly states that if any provisions of other laws are issued in the future, they will be based on the Law on the Capital City. However, in the draft Law on State Budget (revised), it is expected to remove Clause 7, Article 34 of the Law on the Capital City.
Delegate Hoang Van Cuong said that removing Clause 7 must be carefully considered due to the specific geopolitical location of the capital. According to the delegate, retaining the above budget will allow Hanoi to invest in many important infrastructure projects, especially supporting the relocation of agencies and units according to the Hanoi Capital Master Plan to 2045, with a vision to 2065. This is a mechanism for Hanoi to create more resources for development.
Regarding the revenue sharing and percentage between the central budget and local budget (Clause 2, Article 35), delegate Nguyen Thanh Trung (Yen Bai Delegation) said that, compared to the provisions of the current law, the draft Law changes the method of revenue sharing between the central and local budgets. In particular, the budget stabilization period is eliminated, including the period of stabilizing the percentage of revenue sharing between budget levels and the additional balance from the upper-level budget to the lower-level budget within 5 years, coinciding with the 5-year socio-economic development plan or according to the decision of the National Assembly.
Delegate Nguyen Thanh Trung agreed with the opinion of the National Assembly's Economic and Financial Committee according to option 2, when building the annual state budget estimate, the National Assembly will be presented with a specific determination of the division ratio and the additional balance from the upper-level budget to the lower-level budget.
"Such a regulation ensures that the budget stabilization period is eliminated as in the current law, in accordance with the principle in Clause 7, Article 9, and the additional balance of the central budget for local budgets is determined based on the actual situation and implementation of state budget expenditure tasks, ensuring the leading role of the central budget," said delegate Nguyen Thanh Trung.
