The Government has just issued Decree No. 314/2025/ND-CP promulgating the model working regulations of the People's Committees of provinces and centrally run cities.

This Regulation stipulates working principles; responsibility regime; working relationships; scope, methods, and procedures for handling work; work programs, activities, and information and reporting regimes of the People's Committees of provinces and centrally run cities (hereinafter referred to as provincial-level People's Committees).

One of the working principles of the Provincial People's Committee is to operate under a collective regime and make decisions by majority vote; implement the principle of democratic centralism, while at the same time promoting the authority and responsibility of the Provincial People's Committee Chairman and promoting the leadership role of the Provincial People's Committee Chairman.

The organization and operation of the provincial People's Committee must ensure streamlining, efficiency, effectiveness, and efficiency, meeting the requirements of professional and modern local governance, promoting administrative reform, applying information technology and digital transformation, innovation; operating, processing work, exploiting digital data and providing public services in the electronic environment to improve governance efficiency, towards the goal of building digital government, digital economy and digital society.

Data created during the operation of the provincial People's Committee must be complete, accurate, timely, consistent, managed, exploited, used in common, ensuring safety, information security, and state secrets according to regulations, effectively serving the direction, administration, and settlement of administrative procedures; ensuring accountability associated with the power control mechanism; ensuring a transparent, unified, smooth, and continuous administration; preventing and combating corruption, negativity, and waste.

Comply with the order, procedures, authority and deadline for handling work, implement the tasks and powers that are decentralized and delegated; at the same time, promote decentralization and delegation according to the provisions of law, clearly define individual responsibilities associated with strengthening inspection, supervision and monitoring; have a mechanism to monitor, evaluate, check and promptly adjust the content of decentralization and delegation when the tasks and powers that are decentralized and delegated are not implemented effectively.

Ensure human rights and civil rights; build a local government that is close to the people, serves the people, promotes the people's mastery, and is subject to people's inspection and supervision; coordinate and create conditions for the local Vietnam Fatherland Front Committee to effectively implement the social feedback mechanism. Ensure the promotion of the capacity and strengths of cadres and civil servants; promote coordination and information exchange in handling work.

The Decree stipulates the responsibilities, scope, and methods of handling work of the People's Committee, Chairman, Vice Chairman, members of the People's Committee, heads of specialized agencies, other administrative organizations under the People's Committee, Chief of Office of the Provincial People's Committee and work coordination relationships, ensuring the promotion of efficiency, effectiveness, and efficiency of state management and better serving the people and businesses, promoting the role and responsibility of the head of the People's Committee in promptly and promptly handling the tasks and work of administrative agencies.

Specifically, the Chairman of the Provincial People's Committee is the person who leads and manages the work of the Provincial People's Committee, decides on issues under the authority of the Provincial People's Committee on behalf of the Provincial People's Committee, is personally responsible for the performance of assigned tasks and powers according to the provisions of law, and together with other members of the Provincial People's Committee is collectively responsible for the activities of the Provincial People's Committee according to the provisions of the Law on Organization of Local Government and other relevant legal provisions.

The Vice Chairman of the Provincial People's Committee performs duties and powers as assigned by the Chairman of the Provincial People's Committee according to the field and area of ​​work; is entitled to use the powers of the Chairman of the Provincial People's Committee, on behalf of the Chairman of the Provincial People's Committee when handling work in the assigned field.

Members of the Provincial People's Committee are responsible for proactively and actively participating in resolving common tasks of the Provincial People's Committee, fully attending meetings, discussing and voting on issues raised.

The heads of specialized agencies and other administrative organizations under the Provincial People's Committee perform tasks and powers according to the provisions of law and the work assigned or authorized by the Provincial People's Committee or the Chairman of the Provincial People's Committee; prioritize resources, be responsible for the work of building institutions, mechanisms, policies, strategies, planning, plans, direct and be responsible for law enforcement, administrative reform, apparatus organization, construction and development of information technology applications, digital transformation in the organization and operation of agencies and units.

The Chief of Office of the Provincial People's Committee assists the Chairman and Vice Chairman of the Provincial People's Committee in synthesizing the activities of the Provincial People's Committee; proposes to the Chairman and Vice Chairman of the Provincial People's Committee to assign specialized agencies and other administrative organizations under the Provincial People's Committee to study, advise, and propose issues on guidelines, policies, management mechanisms, and decide on handling specific work within the state management functions and tasks.

Where necessary, the Provincial People's Committee shall directly direct and manage the settlement of issues within the duties and powers of specialized agencies and other administrative organizations under its People's Committee, the Commune People's Committee, and the Chairman of the Commune People's Committee, so as not to let the settlement of work and administrative procedures for people and businesses be delayed, congested, or ineffective.

Coordination of work of the Provincial People's Committee

The provincial People's Committee must maintain regular contact and be under the leadership and direction of the Government and the Prime Minister; regularly coordinate with ministries, ministerial-level agencies, and relevant central agencies; ensure a unified and smooth administration from the central to grassroots levels; the provincial People's Committee is under the leadership and direction of the Provincial Party Committee (City Party Committee) in performing political tasks in the locality; maintain regular contact with the agencies of the Provincial Party Committee (City Party Committee) in their work.

At the same time, the Provincial People's Committee closely coordinates and regularly exchanges information with the Standing Committee of the People's Council at the same level in preparing the agenda and working content of the People's Council session, reports, projects, and draft resolutions to be submitted to the People's Council; resolving issues arising in the process of implementing the People's Council's resolutions on local socio-economic tasks; studying and resolving within its authority the recommendations of the People's Council and the People's Council's Committees; and answering questions from People's Council delegates.

The provincial People's Committee coordinates and exchanges information with the National Assembly delegation at the same level; directs and urges the settlement of complaints, denunciations and recommendations of citizens that have been forwarded by the National Assembly deputies and the National Assembly delegation; when requested, the Chairman of the provincial People's Committee and Vice Chairman of the provincial People's Committee direct the heads of specialized agencies and other administrative organizations to attend meetings with voters and survey the actual situation in the locality of the National Assembly deputies to receive and handle related issues.

In addition, the provincial People's Committee closely coordinates and exchanges information with the Vietnam Fatherland Front Committee at the same level to care for and protect the legitimate interests of the people, mobilize people to participate in building and consolidating a strong government, and voluntarily implement policies and laws.

The Provincial People's Committee coordinates and exchanges information with the Provincial People's Procuracy and Provincial People's Court in the fight against crimes, violations of the Constitution and laws, maintaining discipline and administrative order, and propagating and educating the law.

The Provincial People's Committee coordinates and creates conditions for enterprises, organizations, business establishments and individuals in the area to have a favorable, safe and fair investment and business environment, creating conditions to promote socio-economic development.
