In the submission, the drafting agency proposed to increase the drug addiction treatment period for first-time addicts to 24 months, and for second-time addicts to 36 months, applicable to both voluntary and compulsory drug addiction treatment. Currently, the regulation on compulsory drug addiction treatment is 12-24 months.
For addicts aged 12 to under 18, the draft proposes that drug rehabilitation will be carried out at reform schools. When this subject turns 18 and has 3 months or more of drug rehabilitation remaining, he or she will be transferred to a public drug rehabilitation facility.
The Draft Law also proposes that drug testing (XNCMT) in the body will be carried out on groups of people found to be illegally using drugs (SDTPCMT); people under management; people undergoing drug rehabilitation; people undergoing drug treatment with replacement drugs; and people in the post-rehabilitation management phase.
In case the subject is required to undergo XNCMT but does not comply, the competent authority shall apply administrative escort measures to take him/her to the mandatory testing location.
The drafting agency said that the addition of regulations on escorting aims to address the fact that many people who have been asked to undergo drug rehabilitation have not cooperated, causing difficulties for authorities in managing drug addicts.
The above content has received some concerns, because they think that the drug rehabilitation period of up to 3 years is too long or not? Is the measure of escorting XNCMT "excessive" or not?
On the side of the examining agency, the National Assembly 's Committee on Culture and Society determined that the content of increasing the time limit for CNMT contributes to improving the quality of CNMT work; and the majority of opinions of the Committee agreed.
This is also a point of view that many people agree with. Drugs have terrible magic power, getting involved once can "ruin one's life". To give up drugs requires the will of the person quitting, the right circumstances and conditions for drug addiction, a long enough time and strict legal regulations. With the drug problem causing countless terrible consequences for society, it is also necessary to have separate measures in prevention and control, including compulsory testing.
According to statistics, from March 1 to October 31, 2025, 489 people nationwide escaped while waiting for records to be prepared for compulsory drug rehabilitation. The supervision of some drug addicts or those under post-rehabilitation management is still lax, making it easy for them to reuse drugs or violate the law, while current manual management measures cannot control 24/24.
Therefore, some opinions suggest that the draft Law should also add provisions on electronic monitoring of drug addicts; to control movement, reduce the burden on managers, and move towards a community management model. Drugs are now often associated with "crowd culture", music , festivals, and social networks; so the draft Law should also add responsibilities of technology enterprises, digital platforms, and media in PCMT.
Along with the amendments to the Penal Code, considering drug use in some cases as a crime, it is necessary to change some regulations to be more serious in drug prevention and control. In the fight against drug prevention and control, we must take comprehensive measures to move towards a drug-free society.
