The Department of Natural Resources and Environment of Ho Chi Minh City said that the slow issuance of Certificates to home buyers is mainly the fault of the project investor, but it has not been able to handle it.

According to the Department, the main errors are caused by the project investor such as: During the implementation of the investment in the construction of the housing development project, the investor did not construct in accordance with the approved planning and design, or in accordance with the construction permit, or arranged the use of construction items with incorrect functions; The investor adjusted and changed the project planning, leading to the need to determine additional financial obligations; The project's land use right certificate was mortgaged by the investor and has not been released; The investor did not submit or was late in submitting the application for the Certificate to the buyer at the project.

It is worth noting that, according to the provisions of the 2013 Land Law, for the act of "not submitting documents, not providing, or providing incomplete documents to carry out procedures for granting Certificates to buyers, lessees of houses, construction works, and recipients of land use rights at real estate business projects", the Inspectorate of the Department of Natural Resources and Environment can handle administrative violations against investors according to Decree No. 91/2019/ND-CP dated November 19, 11 of the Government on administrative sanctions in the field of land.
However, Decree No. 91/2019/ND-CP has expired and there is no replacement decree, so the Department cannot implement it.
Therefore, with the above concerns, the Department of Natural Resources and Environment of Ho Chi Minh City can only handle them as proposed... The investor should contact relevant departments for guidance and determination of additional financial obligations; request... the investor to promptly carry out the mortgage release.
