The Government Office issued Official Dispatch No. 5854/VPCP-KGVX dated June 25, 2025 conveying the opinion of Deputy Prime Minister Le Thanh Long on handling information reflecting the fight against and prevention of the production and trade of fake functional foods and fake cosmetics.
The Government Electronic Information Portal's report in document No. 533/2025/TTDT dated June 16, 2025, reported on the press coverage of the issue of preventing counterfeit functional foods and handling counterfeit cosmetics. The report stated: In recent days, in many localities across the country, authorities have discovered many cases of thousands of boxes of medicines and functional foods being secretly dumped and destroyed... showing that the production and trade of counterfeit foods and functional foods is taking place in a complicated manner, seriously affecting the health and economy of consumers...
The incidents also raise questions about the effectiveness of inspections and audits by authorities to control and prevent this situation... According to Lawyer Truong Hong Dien, Head of Xuan Phu Law Office, Ho Chi Minh City Bar Association, the drastic and continuous involvement of agencies and departments in inspections and strict handling is the key to preventing counterfeit and poor quality goods, to protect consumers. In addition, it is also necessary to clarify the responsibilities of departments and departments in localities where the trade of functional foods of unknown origin is widespread, affecting consumers. At the same time, along with handling administrative or criminal responsibilities of traders, it is necessary to consider compensation requests for consumers, according to information on the number of goods sold...
The report of the Government Electronic Information Portal also clearly stated the press's reflection on "Handling fake cosmetics: Testing costs are higher than fines" . Specifically, recently, the authorities in Dak Lak have handled 47 violations related to smuggling, trade fraud and counterfeit goods. The total fine is nearly 975 million VND, the violated goods are worth nearly 993 million VND, mainly cosmetics, food and pharmaceutical ingredients. Mr. Mai Manh Toan - Deputy Director of Dak Lak Department of Industry and Trade - said that floating cosmetics and functional foods are appearing more and more, but the handling is still stuck. The biggest difficulty now is the testing stage. After temporarily holding the goods, samples must be sent for appraisal at specialized units. However, the testing cost is very high, even many times higher than the administrative fine. There are cases where the testing cost is up to 100 million VND, while the administrative fine is only 5-7 million VND or a few tens of million VND. If we want to completely deal with the problem of floating, poor quality goods, we need to simplify the testing procedures, creating conditions for the authorities to be able to handle it more resolutely and effectively.
Faced with the above issue, Deputy Prime Minister Le Thanh Long requested the Ministry of Health to continue to resolutely implement the solutions directed by the Prime Minister to prevent, control and handle counterfeit drugs, fake foods and fake cosmetics, focusing on reviewing, researching and perfecting regulations and appropriate tasks and solutions, improving the effectiveness of the fight against and repelling the production and trade of counterfeit foods, pharmaceuticals and cosmetics; paying attention to researching and handling issues raised by the press regarding improving the effectiveness of inspection, examination and testing costs for handling counterfeit cosmetics.
