
The Law amending and supplementing a number of articles of the Intellectual Property Law No. 131/2025/QH15 will officially come into effect on April 1, 2026.
The Law amending and supplementing a number of articles of the Intellectual Property Law No. 131/2025/QH15 was passed by the 15th National Assembly at its 10th session on December 10, 2025, and will officially come into effect on April 1, 2026. The issuance of the implementation plan aims to concretize the tasks, roadmap, and assignment of responsibilities to relevant agencies, ensuring the synchronized, unified, and effective implementation of the Law.
According to the Plan, implementation must be linked to the requirements of scientific and technological development, promoting innovation, digital transformation, private sector development, and socio-cultural fields, thereby maximizing the practical value of the intellectual property protection system.
One of the key focuses is to build a coordination mechanism among ministries, sectors, and localities during the nationwide implementation process; and at the same time, to raise awareness and responsibility of agencies, organizations, and individuals in enforcing the Law.
The plan outlines key tasks including: developing and promulgating detailed regulations and guidelines for implementation; organizing the dissemination of new points of the Law; reviewing, systematizing, and codifying relevant legal documents; forming and implementing a national program to support the creation, protection, exploitation, and development of intellectual property; and strengthening inspection and supervision of implementation.
The drafting of detailed regulations will be carried out according to the assignment in Decision No. 2835/QD-TTg dated December 31, 2025, of the Prime Minister on the list and lead agencies for drafting guiding documents for the implementation of laws and resolutions passed by the National Assembly at its 10th session.
In addition, ministries and agencies are required to strengthen communication efforts, organize conferences to disseminate information and provide professional training; and compile materials introducing the basic content and new points of the Law for publication on the National Legal Education and Dissemination Portal and other mass media outlets.
Alongside the dissemination of information, it is necessary to review the current legal framework, promptly proposing amendments, additions, replacements, or repeal of regulations that are no longer appropriate, ensuring the consistency of the legal system when the Law comes into effect.
The government also requires regular monitoring, urging, and inspection of the implementation process; guidance on the application of new regulations; and professional training related to the protection and exploitation of intellectual property rights, in order to ensure that the Law is implemented effectively and put into practice.
