Opening the conference, Deputy Inspector General of the Government Duong Quoc Huy emphasized: The 2022 Inspection Law inherits the 2010 Inspection Law and adds new regulations based on a comprehensive and in-depth summary of the activities of agencies performing inspection functions today.
Therefore, the Government Inspectorate recommends that localities step up the dissemination and popularization of the 2022 Law on Inspection and its guiding documents, especially the new provisions on persons with inspection authority, to create a basis for effective implementation of inspection activities in the coming time.
The 2022 Law on Inspection consists of 8 chapters and 118 articles, effective from July 1, 2023. The construction of this law is based on the following basic viewpoints and principles: Thoroughly grasping and concretizing the Party and State's guidelines, policies and guidelines on inspection work; in line with the requirements of state administrative reform, creating a legal basis for the process of innovation in the organization and operation of inspection in the spirit of Resolution No. 18/NQ-TW dated October 25, 2017 on Continuing to innovate and streamline the organization and apparatus of the political system to be streamlined and operate effectively and efficiently.
Institutionalize the provisions of the 2013 Constitution in accordance with the functions and tasks of inspection, citizen reception, complaint and denunciation settlement, and prevention and combat of corruption and negativity, contributing to controlling state power and protecting human rights and citizen rights.
Responding to the requirements of strengthening the Party's inspection and supervision work, ensuring effective coordination between the supervision, inspection, examination and auditing work of the state apparatus and the entire political system on the activities of agencies, organizations and individuals.
Clarify and strengthen the responsibility and authority of heads of state management agencies, especially the authority of the Prime Minister, ministers, and provincial People's Committee chairmen in leading inspection work, handling arising issues discovered through inspection activities, organizing the implementation of inspection conclusions, rectifying management work, handling violating officials, and recovering money and assets that have been appropriated or used for the wrong purposes.
Amending the 2010 Law on Inspection based on summarizing the practical organization and operation of inspection; inheriting the relevant provisions of the current Law on Inspection; meeting practical requirements and international integration to develop the country's economy; selectively absorbing the experience of countries around the world on inspection work.
Based on the Law on Inspection 2022, the Government issued 2 decrees including: Decree 43/2023/ND-CP dated June 30, 2023 detailing a number of articles and measures to implement the Law on Inspection 2022; Decree No. 03/2024/ND-CP dated January 11, 2024 on agencies performing specialized inspection functions and activities of agencies assigned to perform specialized inspection functions.
The 2022 Inspection Law has many new points compared to the 2010 Inspection Law such as: adding the state management function on citizen reception and prevention of negativity; stipulating that one inspection can issue many inspection conclusions (Clause 3, Article 78); new regulations on handling overlapping and duplication issues in inspection activities, between inspection activities and state audit activities...
The conference discussed and clarified a number of difficulties and problems in organizing the implementation of the 2022 Inspection Law and government decrees detailing the implementation of this law.
This conference aims to disseminate the 2022 Law on Inspection and its guiding documents to all officials, civil servants and public employees (CIVs) in the entire inspection sector. This will create unity in the implementation process, bringing the provisions of the law into practice. At the same time, it will help CIVs, civil servants and public employees in the entire inspection sector to better understand the provisions of the law on inspection, contributing to the successful completion of assigned tasks.
