
On the morning of December 9, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung presented a report on the examination of reports on the work of the Chief Justice of the Supreme People's Court (SPC), the Chief Prosecutor of the Supreme People's Procuracy (SPP); crime prevention and control; and execution of judgments in 2025.
The UBPLTP acknowledged the positive and comprehensive results in crime prevention and control, and frankly pointed out a number of limitations that need to be overcome. Accordingly, although the investigation and handling of crimes basically followed the provisions of the law, the rate of handling crime reports, denunciations, and recommendations for prosecution only reached 88.12%, not meeting the target set by the National Assembly .
Director Hoang Thanh Tung commented that the Supreme People's Procuracy has annulled many unfounded decisions of the investigation agency, contributing to reducing injustice and mistakes. However, there are still cases where the local procuracy prosecutes but the court of first instance declares that the defendant is not guilty; there are still cases where the investigation of the defendant must be suspended because there is no crime and the behavior does not constitute a crime.
Regarding the judiciary, the investigation agency noted that the trial of criminal, civil and administrative cases all met and exceeded the National Assembly's target on the resolution rate. However, the biggest limitation lies in the quality of the trial, reflected in a number of factors, such as the number of criminal, civil and administrative judgments that were annulled or amended due to subjective reasons.
In particular, for administrative judgments and decisions, the rate of annulment and amendment is still high (3.72%), not meeting the requirements of the National Assembly; the Supreme People's Court needs to focus on rectification to sharply reduce the rate of judgments annulled and amended due to subjective reasons, especially in administrative cases.
The enforcement of civil and criminal judgments has generally achieved positive results. However, the enforcement of administrative judgments still has many limitations, which need to be strongly focused on and overcome. Discipline in the enforcement of administrative judgments is still not strict, the rate of administrative judgment enforcement is only 4.04% compared to 2024. Director Hoang Thanh Tung requested relevant agencies to overcome the situation of lax discipline in the enforcement of administrative judgments.
Based on the review, the Committee for Legal Affairs recommends that the Government, the Supreme People's Procuracy, and the Supreme People's Court direct the continued review of legal provisions in various areas of social life to promptly amend/supplement them; promptly issue documents guiding the implementation of laws and resolutions on the organization and operation of judicial agencies recently passed by the National Assembly. The Ministry of Public Security, the Supreme People's Procuracy, and the Supreme People's Court need to coordinate in reviewing and providing more specific guidance on the coordination between the People's Procuracy, the People's Court, and local investigation agencies, especially when organizing the model of the two-level People's Procuracy and People's Court at the local level. In addition, attention should be paid to investing in facilities, equipment, and funding for judicial agencies after implementing the new organizational model.
