The Ministry of Health's proposal to include the prohibition of investment and business in "electronic cigarettes and heated tobacco products" in Article 6 of the draft Investment Law (amended) is to comply with the provisions of Resolution No. 173/2024/QH15. Previously, Resolution No. 173/2024/QH15 dated November 30, 2024 of the National Assembly on questioning activities at the 8th Session stipulated: "The National Assembly unanimously prohibits the production, trading, import, storage, transportation, and use of electronic cigarettes, heated tobacco products, and gases and addictive substances that are harmful to human health from 2025...". Accordingly, on August 5, 2025, the Prime Minister issued Decision No. 1665/QD-TTg on the plan to implement Resolution No. 173/2024/QH15 of the National Assembly, demonstrating the consistent policy of the National Assembly and the Government of Vietnam in protecting public health.

In Ha Tinh , recently, the authorities have actively promoted, inspected and handled the trade, transportation and use of electronic cigarettes and heated tobacco products. However, in reality, there are still students secretly buying these products through social networks, posing many potential risks to health and social order. The National Assembly's discussion of including the prohibition of investment and trading in "electronic cigarettes and heated tobacco products" in the draft Investment Law (amended) has received high consensus and support from the Ha Tinh delegation and professional agencies.
Delegate Tran Dinh Gia - Deputy Head of the National Assembly Delegation of Ha Tinh province emphasized: “E-cigarettes and heated tobacco products are targeting vulnerable groups such as young people and women, directly threatening the health and future of an entire generation. Not only harmful to health, these products also pose a potential risk of leading to social evils, especially the use of drugs and other addictive substances. If not completely banned, the economic and social burden caused by tobacco will be even greater.”

Delegate Tran Dinh Gia said that including e-cigarettes and heated tobacco products in the list of prohibited investment and business activities in the Investment Law (amended) not only demonstrates the determination to protect people's health but also ensures strictness, synchronization and conformity with international commitments that Vietnam has participated in.
Sharing the same view, Director of Ha Tinh Department of Health Nguyen Minh Duc said: “In fact, e-cigarettes and heated tobacco products have caused many health concerns, especially for young people. A number of cases of hospitalization due to the use of e-cigarettes have been recorded at medical facilities. Therefore, it is necessary to institutionalize the law prohibiting investment and trading in these products to create a solid legal basis, protect people's health and build a healthier living environment. This is a step to concretize the spirit of Resolution 72 of the Politburo on a number of breakthrough solutions, strengthening the protection, care and improvement of people's health in the new period, contributing significantly to the goal of building a healthy, civilized and sustainably developed society."

However, due to many harmful effects that have been warned, the use of e-cigarettes not only causes many non-communicable diseases but also affects the mental health of the young generation, affecting the quality of the country's population. Therefore, after the National Assembly passed the policy of banning the production, trading, import, transportation, storage and use of e-cigarettes in Resolution No. 173/2024/QH15 and is now included in the draft amended Investment Law, it not only demonstrates the determination and thoroughness in implementing the policies and guidelines of the Party and State but also shows the concern for the health of the people and a generation.

"Including the content of banning investment in e-cigarette business into the draft Investment Law is also completely consistent with the direction of General Secretary To Lam on protecting young people from drugs, social evils and addiction risks, avoiding allowing criminal organizations to take advantage of the "cover" to bring banned and addictive substances into schools, public places and young people," Lawyer Bui Hoang Linh Chi further emphasized.
