The Vietnam Federation of Commerce and Industry (VCCI) has just issued a document commenting on the Draft Decree on rooftop solar power development of the Ministry of Industry and Trade .

The draft currently regulates only cases of rooftop solar power installation that cannot be sold to other organizations or individuals, including electricity companies.

Regarding this issue, VCCI cited the opinions of a number of businesses on whether the case of buying and selling electricity between organizations and individuals in the same building is subject to application.

That is the case, in the same building, there are many organizations and individuals using electricity, one of which invests in a solar power system and wants to resell it to other organizations and individuals in the same building. That is, the amount of electricity from the solar power system is only transmitted between individuals and organizations in the same building and is not transmitted through the power company's lines.

According to VCCI, many businesses believe that allowing electricity trading between organizations and individuals in the same building will create more resources to develop solar power, helping to better balance the load (due to limiting excess electricity), so it should be encouraged.

VCCI proposed that the drafting agency amend the regulation to allow the purchase and sale of renewable energy between customers without transmitting it through the national grid.

Along with that, according to the draft, renewable energy projects not connected to the national grid must still carry out registration procedures with the provincial People's Committee.

According to VCCI, according to many businesses, this regulation is unnecessary. Because these are often cases of installing small solar panels to serve some electrical equipment that does not need to operate continuously, such as pumps or have accompanying power storage devices.

Furthermore, this type of renewable energy does not cause any negative impact on grid safety, nor is it limited in total capacity. Therefore, there is no need for the State to manage it through an administrative procedure on electricity.

In case this type of renewable energy project requires management in terms of construction safety or fire prevention and fighting, there are corresponding procedures.

Therefore, VCCI recommends that the drafting agency clearly stipulate that renewable energy projects not connected to the national grid do not need to go through development registration procedures.

In addition, the Draft is stipulating that the capacity of solar power connected to the national grid is limited to 2,600 MW according to Power Plan VIII.

According to VCCI, such a regulation is not really suitable, because this capacity limit applies to both cases with and without grid transmission. Meanwhile, the capacity limit in Power Plan VIII applies to the source capacity of the national grid. In the case of rooftop solar power connected to the grid but not transmitting to the grid, it does not increase the source capacity of the national grid, but only has the meaning of reducing the load.

Therefore, VCCI proposed that the drafting agency amend the regulation in the direction that only the case of rooftop solar power generating electricity to the grid will be limited by the total capacity of 2,600 MW. The case of rooftop solar power connecting to the national grid but not generating electricity to the grid will not be limited by the total capacity.

In addition, according to many businesses, the installation of solar power is still facing many difficulties. Administrative procedures on construction, fire prevention and fighting, and environmental protection for solar power are still not really clear and are applied differently in different localities.

Enterprises believe that one of the most important measures to develop renewable energy is to have clear and transparent regulations and uniform application of administrative procedures so that businesses and people can apply them conveniently.

Therefore, VCCI recommends that the drafting agency add policies on reviewing legal regulations in other fields related to the installation of solar power and propose amendments to this decree.
