Why does the Ministry of Public Security propose no age limit for vehicle registration?

What age can register a vehicle?

The Ministry of Public Security is soliciting comments on the draft Circular regulating the issuance and revocation of registration and license plates of motor vehicles and specialized motorbikes.

This Circular regulates the following contents: First-time vehicle registration; vehicle transfer registration, vehicle transfer; issuance and change of vehicle registration certificate, license plate; re-issuance of vehicle registration certificate, license plate; temporary vehicle registration; revocation of vehicle registration certificate, license plate; registration, issuance of license plate of auction-winning vehicles...

If the draft is passed, authorities will no longer limit the age of people coming to register vehicles.

The new circular proposes to adjust one content, notably the age requirement when registering a vehicle.

According to the Ministry of Public Security, currently, Clause 9, Article 3 of Circular No. 24/2023/TT-BCA stipulates that individuals aged 15 years or older are allowed to register a vehicle. In case an individual aged 15 to under 18 years old registers a vehicle, he/she must have the consent of his/her parent or guardian and write "consent", sign, and clearly state the full name and relationship with the person under guardianship in the vehicle registration form.

Currently, from August 1, the Ministry of Public Security has implemented the regulations in Circular No. 28/2024 on online vehicle registration (for domestically manufactured and assembled vehicles). People only need to register a level 2 VNeID account to be able to sit at home to register their vehicle and get a license plate, without having to go directly to vehicle registration points as before.

However, according to the Drafting Committee of the Ministry of Public Security, Official Dispatch No. 729/GM-KTrVB dated August 9, 2023 of the Department of Inspection of Legal Normative Documents ( Ministry of Justice ) stated that the Circular regulating the age limit for vehicle registration is baseless and restricts citizens' rights.

In response to comments from the Ministry of Justice, the draft Circular has amended and supplemented the following content: When registering a vehicle, minors must have the consent of their legal representative and write "consent", sign, and clearly state their full name and relationship with that person in the vehicle registration form.

Thus, with this proposal, the authorities no longer limit the age of people coming to register vehicles.

How to register auction winning motorcycle license plates?

Also in this draft, the Ministry of Public Security proposed more details on the declaration and submission of vehicle registration documents after Circular No. 28/2024 takes effect from August 1.

Accordingly, to facilitate organizations and individuals to use a variety of online public service channels, ensuring fairness among subjects when carrying out vehicle registration procedures, the draft Circular has amended and supplemented regulations on vehicle registration declaration on VNeID, online public services or directly at the vehicle registration agency.

The procedure for registering a license plate for a motorbike that wins the auction will be similar to that for registering a license plate for a car that wins the auction (illustrative photo).

Thus, people will have more options when registering cars and motorbikes, including: National Public Service Portal, Ministry of Public Security Public Service Portal, VNeID application, other online public service channels as prescribed or directly at the vehicle registration agency.

In case of first-time vehicle registration using the full online public service, the vehicle owner declares vehicle registration on the public service portal or on VNeID.

In addition, the draft also proposes regulations on registration and issuance of license plates for vehicles winning the auction. Accordingly, the license plates put up for auction are license plates for cars, motorbikes, and scooters and are made public for organizations and individuals to choose to register to participate in the auction.

According to the provisions of Resolution No. 73/2022/QH15 dated November 15, 2022 of the 15th National Assembly regulating the pilot auction of automobile license plates, the draft supplements regulations on the registration and management of license plates of motorbikes and scooters winning the auction, similar to the registration and management of license plates of automobiles winning the auction.
