Why not make a fixed Lunar New Year holiday plan every year?

Người Đưa TinNgười Đưa Tin30/09/2023

At the regular Government press conference held on the afternoon of September 30, Deputy Minister of Labor, War Invalids and Social Affairs Le Van Thanh explained the reason why every year, the Lunar New Year holiday plan is periodically prepared and the opinions of units are sought, instead of having a unified regulation for many years.

Mr. Thanh said that in terms of legal basis, Clause 3, Article 112 of the Labor Code stipulates that every year, based on actual conditions, the Prime Minister decides on Lunar New Year holidays and National Day.

Therefore, every year, the Ministry of Labor, War Invalids and Social Affairs advises the Prime Minister to decide on the Lunar New Year and National Day holidays based on the opinions of central ministries and branches. According to regulations, Lunar New Year is a 5-day holiday and National Day is a 2-day holiday.

Deputy Minister Thanh said that in practice, the Lunar New Year and National Day holidays are not fixed, and are interspersed with weekly holidays (Saturday and Sunday). Therefore, it is necessary to come up with a plan to seek opinions from many relevant parties and choose the most suitable and optimal plan, beneficial to workers, business units and harmonizing interests among the subjects.

"The construction agency proposes a holiday schedule, considering and calculating it to be most beneficial for workers, with workers at the center," said Deputy Minister Le Van Thanh.

Policy - Why not make a fixed annual Lunar New Year holiday plan?

Deputy Minister of Labor, War Invalids and Social Affairs Le Van Thanh.

Previously, in the draft of the Ministry of Labor, War Invalids and Social Affairs seeking opinions from ministries and branches to submit to the Prime Minister to propose a plan for the 2024 Lunar New Year holiday, the Ministry proposed two options for the holiday, both lasting 7 days, only differing in the starting time of the holiday.

Option 1 is that civil servants and public employees will have 7 days off from Thursday, February 8, 2024 to Wednesday, February 14, 2024 (ie December 29, year of the Cat, to January 5, year of the Dragon). With this option, on the occasion of Lunar New Year 2024, civil servants and public employees will have 2 days off before Tet and 5 days off during Tet (including 5 days off for Lunar New Year and 2 days off in lieu of weekly days off).

Option 2, the Ministry of Labor, War Invalids and Social Affairs also proposed a 7-day holiday but 1 day before Tet and 6 days during Tet. Accordingly, civil servants and public employees will have a holiday from Friday, February 9, 2024 to Thursday, February 15, 2024 (ie December 30, Quy Mao year to January 6, Giap Thin year).

With option 2, on the occasion of Lunar New Year, civil servants and public employees will also have 7 days off (including 5 days off for Lunar New Year and 2 days off in lieu of weekly days off).

According to the Ministry of Labor, War Invalids and Social Affairs, both proposed options have the same number of days off, but the Ministry of Labor, War Invalids and Social Affairs proposes choosing option 1 for the holiday schedule of officials, civil servants and public employees because it ensures harmony in the time off before and after Tet.

After receiving the official dispatch from the Ministry of Labor, War Invalids and Social Affairs on 2 options for the 2024 Lunar New Year holiday, the Ministry of Home Affairs has studied the draft document to send to the Prime Minister. According to the draft, the Ministry of Home Affairs agrees with option 1 as proposed by the Ministry of Labor, War Invalids and Social Affairs.

According to this plan, cadres, civil servants and public employees will have Tet holiday for the year of the Dragon 2024 from February 8, 2024 (December 29) to February 14, 2024 (January 5), with a total of 7 days off .
