BNB Hanoi company was fined for building 20 villas with incorrect design

The Chairman of the People's Committee of Thanh Hoa City, Thanh Hoa Province has just issued Decision No. 3587/QD-XPHC on administrative sanctions against BNB Hanoi Company Limited (headquartered on the 3rd floor, Tay Ha Building, Phung Khoang urban area, Trung Van ward, Nam Tu Liem district, Hanoi city) by Mr. Do Minh Tien - Chairman of the Board of Members, the legal representative, with a total fine of 107.5 million VND.

Specifically, BNB Hanoi Company Limited constructed a project that was not in accordance with the approved construction design at the rough construction and exterior finishing project of 257 lots (phase 1), Dong Phat Urban Southeast Residential Area project, Quang Thanh ward, Thanh Hoa city, Thanh Hoa province as stipulated in Clause 8, Article 16 of Decree No. 16/2022/ND-CP dated January 28, 2022 of the Government regulating administrative sanctions for construction violations.

BNB Hanoi Company Limited has increased the floor area of the 4th floor at lots 54, 59, 97, 98, 145, 274, 295. Increased the area of the 1st floor (form: building walls as high as the 1st floor, locking concrete beams, building auxiliary works on the land with construction density setback) at lots: 154, 157, 158, 159, 239, 267, 277, 280, 286, 289, 271, 274, 303. For this violation, BNB Hanoi Company Limited was fined 90 million VND.

Thanh Hoa City authorities discovered that during the construction process, BNB Hanoi Company did not cover the construction site, causing construction materials to fall onto the surrounding area. For this action, Thanh Hoa City People's Committee decided to fine BNB Hanoi Company 17.5 million VND.

The Chairman of Thanh Hoa City People's Committee ordered BNB Hanoi Company Limited to stop construction at the violating works. Within 90 days from the date of issuance of the decision on administrative sanctions, BNB Hanoi Company Limited must complete the dossier requesting the competent authority to adjust the construction design for the rough construction and exterior finishing of 257 lots (phase 1) of the Dong Phat Urban Southeast Residential Area project, Quang Thanh ward, Thanh Hoa city.

After the 90-day period, if BNB Hanoi Co., Ltd. fails to present the revised construction design that has been appraised, it shall demolish the violating part of the construction according to the provisions of Clause 16, Article 16, Article 81, Decree No. 16/2022/ND-CP dated January 28, 2022 of the Government. BNB Hanoi Co., Ltd. shall be required to cover the construction and remedy the situation of construction materials falling into surrounding areas within 10 days from the date of issuance of the penalty decision. All costs of organizing the implementation of remedial measures shall be borne by BNB Hanoi Co., Ltd.
