Handling difficulties and problems in building and managing the National Database on handling administrative violations

(laichau.gov.vn) The Government issued Resolution No. 66.9/2025/NQ-CP dated December 8, 2025 on handling difficulties and problems in regulations on responsibility for building and managing the National Database on handling administrative violations.

Handling difficulties and problems in building and managing the National Database on administrative violations handling.

This Resolution stipulates the responsibilities of ministries, branches and localities in building and managing the National Database on handling administrative violations during the period when the Law on Handling Administrative Violations (amended) has not been promulgated. Specifically:

The Ministry of Public Security is responsible for building and managing the National Database on handling administrative violations in a centralized, unified, and shared manner nationwide; and performing the responsibilities of the competent authority of the National Database on handling administrative violations in accordance with the law on electronic transactions.

The Ministry of Justice exploits and uses the National Database on Administrative Violations to manage the enforcement of laws on administrative violations in accordance with the provisions of law.

Within the scope of their tasks and powers, ministries, ministerial-level agencies, and People's Committees at all levels shall promptly provide information on administrative violation handling to the Ministry of Public Security to develop and update the National Database on Administrative Violations Handling.

The Supreme People's Court, the Supreme People's Procuracy , and the State Audit shall coordinate with the Ministry of Public Security to develop and manage the National Database on Handling of Administrative Violations; direct the People's Courts at all levels, the People's Procuracies at all levels, and agencies under the State Audit to promptly provide information on handling of administrative violations to the Ministry of Public Security to develop and update the National Database on Handling of Administrative Violations.

Ministers, Heads of ministerial-level agencies, Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, State Auditor General, Chairmen of People's Committees of provinces and cities are responsible for implementing this Resolution, ensuring publicity, transparency, efficiency, feasibility; leaving no loopholes, corruption, negativity, loss, or waste.

List of legal documents proposed to be amended and supplemented

To ensure consistency and synchronization, the Resolution also issued a list of 6 legal documents that need to be amended and supplemented, including:

1- Law on Handling of Administrative Violations No. 15/2012/QH13 is amended and supplemented by Law No. 67/2020/QH14 and Law No. 88/2025/QH15.

2- Decree No. 20/2016/ND-CP regulating the National Database on handling administrative violations.

3- Decree No. 11/2020/ND-CP regulating administrative procedures in the field of State Treasury.

4- Decree No. 118/2021/ND-CP detailing a number of articles and measures to implement the Law on Handling of Administrative Violations, amended and supplemented by Decree No. 68/2025/ND-CP and Decree No. 190/2025/ND-CP.

5- Decree No. 278/2025/ND-CP stipulates mandatory connection and data sharing between agencies of the political system.

6- Circular No. 09/2025/TT-BTP guiding the functions, tasks and powers of the Department of Justice under the People's Committee of provinces and centrally-run cities and the functions, tasks and powers of the Office of the People's Council and People's Committee under the People's Committee of communes, wards and special zones in the judicial field.

This Resolution takes effect from the date of issuance until February 28, 2027.

In case a law of the National Assembly is amended, supplemented or newly promulgated and takes effect after the date this Resolution is passed and before March 1, 2027, the corresponding provisions promulgated in this Resolution shall cease to be effective.
