Recently, the People's Committee of Ho Chi Minh City issued a decision requiring Binh Xuyen restaurant (Binh Chanh district, Ho Chi Minh City) to voluntarily implement remedial measures.

Accordingly, the restaurant owner is required to take remedial measures for the administrative violation of converting rice paddy land to non -agricultural land in a rural area without permission from the competent state authority, covering a total area of ​​over 13,000 . This includes over 7,700 of built-up land and the remainder being fish ponds and plant beds. The built-up area consists of a steel frame, thatched roof, and leaf walls… Failure to comply will result in enforcement action as prescribed by law.

The investor requested to retain the facility to provide for the livelihoods of nearly 200 workers.

Immediately after receiving this decision, nearly 200 workers at the restaurant submitted a petition to the leaders of Ho Chi Minh City requesting that the restaurant be allowed to remain open until the Lunar New Year, after which they would dismantle it themselves. Currently, most of them are migrant workers from other provinces, facing difficult living conditions and forced to seek work elsewhere, hoping for a stable income to support their families, children, and parents back home. The majority are the primary breadwinners of their families and have been working at Binh Xuyen restaurant for over ten years. Therefore, the wages paid by the restaurant are their main source of income to maintain their livelihoods.

During the recent Covid-19 pandemic, their lives were turned upside down with countless difficulties when the restaurant closed for nearly a year to combat the epidemic. Life stabilized when the restaurant reopened almost a year later, but then economic hardship struck again. “If the restaurant is demolished, we and our families don’t know what will become of us, how difficult it will be to suddenly lose our jobs again. From being the main breadwinners, we will become a burden to our families and society, leading to many other consequences for hundreds of families, especially with Tet (Lunar New Year) approaching. We respectfully request that the authorities reconsider the decision to demolish Binh Xuyen Restaurant. Allowing Binh Xuyen Restaurant to remain would also help us workers have stable jobs as we do now, to provide for ourselves and our families, and most importantly, to have a warm and joyful Tet,” stated the collective petition of the staff of Binh Xuyen Restaurant.

The landowners who leased land to Binh Xuyen restaurant have also collectively submitted petitions to the authorities requesting that their establishments be allowed to remain until the land is included in the planning scheme, and have pledged to voluntarily dismantle their businesses without demanding compensation.

Mr. Vo Van On, residing at C3/17, Hamlet 4, Binh Hung Commune, Binh Chanh District, Ho Chi Minh City, representing four landowners, stated that his family owns a plot of land measuring 8,000 , comprising rural and agricultural land, at the aforementioned address. This land has been passed down from his grandparents since 1954 and has survived numerous wartime events, unlike other cases in the area where land is often subdivided and sold off through informal, handwritten agreements long ago.

In 1992, the government announced the land would be zoned as Zone B, with Phu My Hung Company as the investor. However, for the past 28 years, this has remained a "stalled" project, and his family has not received any compensation agreement. Originally relying solely on farming, the area surrounding the land has become urbanized with hundreds of brick houses springing up, making it impossible for his family to continue gardening or rice farming. His children have switched to selling pho and vegetables at the market; and he and his wife, both over 80 years old, are unable to work. Therefore, he leased the land to his nephew, Tran Duy Nha, to run a restaurant and earn a living while waiting for the project to be implemented.

The developer commits to demolition without compensation.

“My family has always complied with state regulations, waiting for compensation to carry out projects that benefit society and the country. However, currently, the plan is still pending, the project has not been implemented, and the land has not been compensated. Therefore, we respectfully request that the leaders consider and assist our family in allowing the structure to remain until the project is implemented. The restaurant's operation also provides employment for hundreds of unskilled workers and generates additional tax revenue for the state. We request that the authorities allow the structure to remain and commit to dismantling it once the project is implemented. Leaving the land vacant not only causes waste but also gives rise to many social problems and pollutes the environment. We commit to complying with the law and implementing the state's policies by voluntarily dismantling the structure without demanding compensation when the state implements the project,” Mr. On petitioned.

Mr. Tran Duy Nha, owner of Binh Xuyen Restaurant, also stated that he leased the restaurant from four households on an area of ​​25,000 square meters . The existing structures, dating back to 2003, included guesthouses, gardens, fish ponds, duck coops, cattle sheds, and a football field. He then renovated the property using lightweight materials such as bamboo, mangrove wood, and coconut leaves, incorporating greenery to create an eco-friendly restaurant. Currently, the restaurant employs nearly 200 workers (previously over 300, but due to economic difficulties, some have had to be reduced), mostly people from other provinces facing economic hardship, working in jobs such as security, cleaning, landscaping, cooking, and serving. Each year, the restaurant pays its taxes to the state budget in full and has received numerous commendations from local, city, and central authorities.

Mr. Tran Duy Nha stated that the business registration certificate issued to him by the Binh Chanh District People's Committee in 2010 clearly stipulated that he must cease business operations without demanding compensation for damages, as per the commitment made on January 12, 2010, when the State implemented the project according to the plan. Therefore, he hopes that the authorities will consider both legal and ethical considerations and allow the restaurant to continue operating. He will voluntarily dismantle the structure without demanding compensation to provide employment for hundreds of workers, especially after the Covid-19 pandemic, when people and businesses are still facing many difficulties.
