Commentary on the Notary Law 2024

On November 26, 2024, the 15th National Assembly of the Socialist Republic of Vietnam, 8th session, passed the Notary Law 2024. From the perspective of legislative history, the Notary Law 2024 is the third law of the Socialist Republic of Vietnam regulating the notary field in our country, replacing the Notary Law 2014, which was amended and supplemented in 2018 and 2023 - a law that has been in practice for nearly 10 (ten) years. The birth of the Notary Law 2024 marks a great and very important step forward in the process of building and perfecting the notary institution in our country.

The Notary Law 2024 was passed by the 15th National Assembly of the Socialist Republic of Vietnam, 8th session, on November 26, 2024.

In the 2024 Notary Law, in addition to inheriting the provisions that are still valid and upgrading many provisions that have been verified in practice in the recent past, lawmakers have added a number of completely new provisions that have never been present in legal documents regulating the field of notarization in the past. On the contrary, a number of procedural provisions that were recorded in the 2014 Notary Law or previously the 2006 Notary Law have also been removed from the content of the 2024 Notary Law and assigned to individuals and organizations with the authority to specify details and guide implementation to comply with the provisions of the law on promulgation of legal documents as well as compatible with the functions, tasks and powers prescribed by law of these individuals and organizations.

In particular, in the 2024 Notary Law, we also see a number of amendments and supplements related to notarization procedures and processes in a direction that is closer to and more connected with corresponding regulations recorded in legal documents regulating a number of areas closely related to notarization activities such as civil, land, housing, real estate business, enterprises, marriage and family, etc.

In order to provide readers with a comprehensive view of the provisions of the 2024 Notary Law in the face of rapid changes in practical life as well as the amendment and supplementation of many laws directly or indirectly related to this activity, the Justice Publishing House publishes the book "Commentary on the 2024 Notary Law".

From the perspective of a notary, the authors have analyzed and commented on some contents of the Law mainly based on their own practical experience, the requirements and objective demands of life are placed in comparison with the contents of legal documents regulating some areas closely related to notary activities. Each chapter consists of two parts: general comments and comments on each specific law.
