On November 26, 2024, the 15th National Assembly of the Socialist Republic of Vietnam, at its 8th session, passed the 2024 Notarial Law. From a legislative history perspective, the 2024 Notarial Law is the third law of the Socialist Republic of Vietnam regulating the field of notarization in our country, replacing the 2014 Notarial Law, which had been amended and supplemented in 2018 and 2023 – a law that had been in practice for nearly 10 (ten) years. The enactment of the 2024 Notarial Law marks a significant and important step forward in the process of building and perfecting the notarization institution in our country.

In the 2024 Notarial Law, in addition to inheriting existing provisions and upgrading many provisions that have been proven in practice, lawmakers have added several completely new provisions that were not present in previous legal documents regulating the field of notarization. Conversely, some procedural regulations that were previously included in the 2014 Notarial Law or even the 2006 Notarial Law have been removed from the 2024 Notarial Law and delegated to competent individuals and organizations to provide detailed regulations and guidance for implementation, in accordance with the legal provisions on the promulgation of legal documents and compatible with the functions, duties, and powers of these individuals and organizations as stipulated by law.
In particular, the 2024 Notarial Law also includes several amendments and additions related to the procedures for notarization, moving towards alignment and integration with corresponding regulations found in legal documents governing areas closely related to notarization activities such as civil law, land, housing, real estate business, enterprises, marriage and family law, etc.
To provide readers with a comprehensive overview of the regulations of the 2024 Notarial Law in light of the rapid changes in real-life practices and the amendments and additions to many laws directly or indirectly related to this activity, the Justice Publishing House has published the book "Commentary on the 2024 Notarial Law".
From the perspective of a notary public, the authors have analyzed and commented on several aspects of the Law, primarily based on their own practical experience and the objective demands of life, compared with the content of legal documents regulating several fields closely related to notary activities. Each chapter consists of two parts: an overview and commentary on specific articles of the law.
