On the other hand, currently, many localities have signed agreements to send workers to work abroad with competent foreign agencies (in a seasonal form) but they have not been specifically stipulated in the Law, so Many workers also do not have access to capital.
In the draft, the Ministry of Labor, War Invalids and Social Affairs proposes to amend and supplement regulations on subjects borrowing capital to work abroad, including: (1) Workers working abroad under contracts. contract and (2) Employees going to work abroad under an agreement between the state management agency on employment at the provincial level and a competent foreign agency.
Priority is given to borrowing capital to work abroad under contract
The Ministry of Labor, War Invalids and Social Affairs proposes to amend and supplement regulations on priority of borrowing capital to work abroad under contract for the following subjects:
1- Workers are ethnic minorities.
2- Workers are people from poor or near-poor households.
3- Workers belong to households that have just escaped poverty, or households with an average standard of living.
4- Workers are relatives of people who contributed to the revolution.
5- Workers from ethnic minority and mountainous areas.
6- Workers in extremely difficult communes in coastal, coastal and island areas.
7- Workers whose land is recovered.
8- Young workers who complete military service, police service, youth volunteers after completing programs, schemes, projects, young intellectual volunteers after completing work tasks in economic and defense zones.
Subjects specified in Points 1, 2, 4, 5, 6, 7, 8 above can borrow capital to support working abroad under contracts with lower interest rates.
Loan conditions
According to the draft, workers according to the above regulations can borrow capital to work abroad under a contract when they meet the following conditions:
1- Have full civil act capacity.
2- Have signed a contract with a service enterprise or non-business organization sending workers to work abroad under the contract or have been recruited to work abroad under an agreement between the employment agency. province with competent foreign agencies.
3- Register permanent residence in the locality where you need to borrow capital.
4- Have loan guarantees according to legal regulations.
The Government regulates the loan amount, term, loan interest rate and loan security conditions.
Loan order and procedures
According to the draft, workers who need to borrow capital to support working abroad must submit a loan application to the Social Policy Bank where they register their permanent residence.
Within 10 working days from the date of receiving the loan application, the Bank for Social Policies will organize the appraisal and approval of the loan application. If an approval decision is not made, the Bank for Social Policies shall notify the employee in writing and clearly state the reason.
The Government regulates the order and procedures for borrowing capital.
