What is the 'way' for the Van Ly quarry to operate?

Following a series of articles by the Vietnam News Agency (TTXVN) exposing serious violations at the Van Ly quarry in Nguyen Nghiem commune, Quang Ngai province, mining and processing activities at the quarry have temporarily ceased. In recent days, some residents have hung banners and gone to the company's gate demanding payment. However, instead of cooperating with authorities to resolve the issue, Hoang Nguyen Hai One-Member Limited Company (Hoang Nguyen Hai Company), the owner of the Van Ly quarry, remains inactive, further exacerbating the situation.

Cooperation… something we haven't seen before.

While authorities at all levels are striving to resolve obstacles so that the Van Ly quarry can operate, Hoang Nguyen Hai Company seems uncooperative whenever the authorities need to coordinate.

On September 25th, Hoang Nguyen Hai Company submitted document No. 18/TTr-Cty to the People's Committee and the Police of Nguyen Nghiem Commune. According to document No. 18, Hoang Nguyen Hai Company asserted that the situation at the quarry is very complex. Recently, many individuals have brazenly erected barricades to prevent workers and trucks from transporting stone, aiming to prevent the company from mining at the Van Ly quarry. They earnestly request assistance from the relevant authorities.

Speaking with a reporter from the Vietnam News Agency (TTXVN), Mr. Nguyen Trung Truc, Chairman of the People's Committee of Nguyen Nghiem commune, said: The land plot used for the transportation road of the Van Ly quarry does not belong to Hoang Nguyen Hai Company. Resolving the conflict between the company and the landowner to facilitate the flow of materials is difficult because the leaders of Hoang Nguyen Hai Company are not directly involved in the matter. Mr. Nguyen Trung Truc has also contacted the company director many times, but the director does not answer the phone or appear to resolve the conflict, so the matter remains unresolved.

In response to the above situation, the People's Committee of Quang Ngai province recently issued document No. 2856/UBND-CBXD regarding the resolution of obstacles and impediments to the exploitation, processing, and transportation of materials at the Van Ly quarry. The provincial leadership requested Hoang Nguyen Hai Company to urgently remove the barriers on the transportation routes and resume operations to supply stone materials for key provincial projects. The removal of the barriers must be completed before September 29th.

However, despite the deadline set by the Provincial People's Committee, Hoang Nguyen Hai Company remains inactive. Mr. Nguyen Trung Truc, Chairman of the Nguyen Nghiem Commune People's Committee, affirmed: "According to the Quang Ngai Provincial People's Committee's directive, the work should have been completed by September 29th, but since the document was issued, the company has shown no signs of removing the barriers. The commune's leaders have contacted the company's director many times but to no avail, even though they have signed documents sent to the authorities requesting assistance in dismantling the barriers."

We will advise the province to revoke the license.

The delay by Hoang Nguyen Hai Company in supplying stone materials for construction projects in Quang Ngai province is causing concern among authorities and affecting the reputation and progress of key projects in the area.

According to Document No. 2856, the Chairman of the Provincial People's Committee assigned the Department of Agriculture and Environment to monitor the situation. After September 29th, if Hoang Nguyen Hai Company has not yet commenced the exploitation, processing, and supply of stone materials, the Department of Agriculture and Environment will study the matter and take appropriate action, or advise the Provincial People's Committee to consider and handle the issues within its authority as prescribed by law.

Under pressure from the Provincial People's Committee, in recent days, workers at the Van Ly quarry in Nguyen Nghiem commune (Quang Ngai province) received a notice about the resumption of production. The notice noted: "In case you arrive at the company gate but there is no entrance, please wait in the area in front of the gate so that the company can arrange for someone to help open the fence." However, in recent days, when a reporter from the Vietnam News Agency visited, the Van Ly quarry was still not operational.

Mr. Nguyen Trung Truc, Chairman of the People's Committee of Nguyen Nghiem commune, said: "To date, after September 29th, the company has not taken any action to remove the barriers. The company director has not given any instructions to remove the barriers, so the employees have not removed them."

According to Mr. Vo Minh Vuong, Deputy Director of the Department of Agriculture and Environment of Quang Ngai province, "We have conducted on-site inspections, worked with relevant departments, and advised the Provincial People's Committee. The conflict can only be resolved by the mine owner; this is a civil matter. This mine is designated as a source of materials for the expressway. If the mine owner fails to provide the materials as stipulated in the license, according to the policy outlined in Government Resolution No. 60/NQ-CP, the department will advise the province to revoke the mine's license."

Previously, the Vietnam News Agency (TTXVN) published numerous articles reflecting on violations related to suspected tax and fee evasion, as well as a series of other violations over the four years from 2017 to 2021. Specifically, the tax settlement data for resource tax from 2017 to 2021, as monitored by the tax authorities, shows that Hoang Nguyen Hai Company declared 516,372 m3 of quarry stone at Van Ly to pay resource tax and environmental fees. However, a direct comparison with the tax office at Da Nang City (value-added tax) revealed that the actual volume extracted was 938,234 m3. Hoang Nguyen Hai Company evaded resource tax and environmental protection fees in Quang Ngai province amounting to over 420,000 m3 of quarry stone.

Reportedly, the Investigation Police Department of Quang Ngai province has launched an investigation into alleged "tax evasion and violations of regulations on invoice management" by Hoang Nguyen Hai Company.
