
Appropriate adjustment
The Department of Planning and Investment announced that the project "Dredging of the Ky Ha Port entrance channel, phase 2" has been approved by the Provincial People's Council on October 30, 2015. The total investment is nearly 199.5 billion VND, funded by targeted central government budget support, and will be implemented from 2017 to 2020.
According to this project, the channel section from Ky Ha port to Tam Hiep port will be upgraded. The total length is 6.2km (5.9km channel and 0.3km turning basin), the channel bottom width is 100m, and the channel depth is -9.5m (nautical chart depth).
However, according to the revised master plan for the Chu Lai Open Economic Zone (OEZ) until 2035, with a vision to 2050, Ky Ha port (now Chu Lai port) will be studied for upgrading to a Class I port (national port).
In addition, the plan also includes opening a new channel from the Cua Lo area, accommodating ships of 30,000-50,000 tons. Meanwhile, the current channel into Ky Ha port needs adjustment and supplementation to ensure consistent depth along the entire channel from buoy number 0 to Tam Hiep wharf (11km long).

The Provincial People's Committee has acknowledged its shortcomings and hopes to find solutions to rectify them in order to finalize the project, complete the accounts, and transfer it to a new investor. The project will be socialized and expanded. If this issue is not resolved definitively, investment opportunities for Chu Lai Port will be difficult.”

According to Mr. Nguyen Quang Thu, Director of the Department of Planning and Investment, the project implementation period has expired. To ensure timely completion of the necessary documents and procedures for project suspension and final settlement, the project implementation time must be adjusted.
The adjustments do not exceed the total investment of the project. However, these adjustments have changed the objectives, scope, and scale of the investment compared to the approved investment plan, and the project falls under the category requiring adjustments in accordance with the Law on Public Investment.
This serves as the basis for terminating the project, completing the subsequent procedures, submitting it to the Provincial People's Council for consideration and adjustment of the investment policy, and halting the project, thus concluding the project and handing it over to the enterprise for socialized implementation.
Awaiting the results of the 25th Session
The current shipping channel is only capable of accommodating small to medium-sized vessels. This channel has been silted up, causing significant difficulties for ships entering and leaving Chu Lai port. The port cannot be utilized to its full capacity.

At the meeting on March 11, 2024, with the Provincial Economic Zones and Industrial Parks Management Board and the meeting with the Provincial Party Standing Committee on March 18, 2024, Truong Hai Group proposed to self-fund the dredging project and committed not to request reimbursement from the state.
On May 17, 2024, the Provincial People's Committee agreed in principle to halt the implementation of the project "Dredging the Ky Ha port entrance channel, phase 2" and allowed THACO to proceed with the project "Dredging to deepen the Ky Ha channel to a depth of -9.3m" (according to Official Letter No. 3557).
The Provincial People's Committee requests the Provincial Management Board of Economic Zones and Industrial Parks to determine the technical stopping point, acceptance testing, payment for completed work, and final settlement to conclude the project in accordance with regulations.
The Provincial People's Committee submitted a proposal to the Provincial People's Council at its 24th session, 10th term, to adjust the investment policy and halt the implementation of the "Dredging of the Ky Ha Port entrance channel (phase 2)" project, but it has not yet been approved.
On July 29, 2024, the Chairman of the Provincial People's Committee, Le Van Dung, requested relevant departments and agencies to review and report on the implementation process, from the current status of the project to the responsibilities of the Provincial People's Committee, relevant departments and agencies, and any limitations and obstacles, especially those related to the implementation of legal regulations concerning the procedures for adjusting the investment policy of the project.
Clarify the reasons for adjusting the scale, objectives, capital structure, and determine a suitable project implementation timeline. The entire process will be submitted to the Provincial People's Council for consideration and approval of the project's investment policy adjustments, ensuring the legal basis for implementing subsequent phases.
Recently, the Ministry of Transport requested Quang Nam province to urgently complete the final settlement of the old project and hand over the Ky Ha maritime channel to the Ministry of Transport for management. After the handover and acceptance of the Ky Ha maritime channel is completed, the Ministry of Transport will consider approving Truong Hai's proposal to carry out dredging of this maritime channel.
The adjustment to the investment policy for the project "Dredging the maritime channel into Ky Ha port, phase 2" will be submitted to the 25th session of the 10th Provincial People's Council for approval.
At the meeting on the afternoon of August 8, 2024, with relevant departments and agencies, the Standing Committee of the Provincial People's Council unanimously approved the report and proposal to adjust the investment policy for the project "Dredging the maritime channel into Ky Ha port, phase 2". The agreed contents included halting the project, restructuring the capital sources, and adjusting the implementation time after many thorough and responsible discussions, with a complete legal basis for the Provincial People's Council to issue a resolution.
