Imprisoned for aggressive behavior.

Việt NamViệt Nam27/02/2025

- After drinking alcohol, Nguyen Tri Thien (born in 1997) got into a conflict and fought with Nguyen Trung Tin (born in 1991, residing in Dong Thinh 4 hamlet, My Phuoc ward, Long Xuyen city). As a result, one person was injured by a knife, while the other went to prison for his aggressive behavior.

The two defendants, Tài and Tín, confessed to their actions in court.

At approximately 2 PM on April 10, 2022, Thien went to his friend's house (Dang Hoang Xinh, residing in My Phuoc ward) to drink with a group of acquaintances, including Tin, Luong Van Tai (born in 1999, residing in Dong Thinh 4 hamlet), and a young man named Tuan (whose identity and background are yet to be determined). During the conversation, Thien loudly cursed, causing discomfort to the drinking group. Tin and Xinh tried to fight, but were separated. Having decided not to drink anymore, Thien left.

After Thien left, the remaining people wanted to continue drinking, but Xinh's family wouldn't allow it. Tin suggested going to a pub on Trieu Quang Phuc Street. Seeing his friends arguing and wanting to vent their frustration, Tai suggested inviting Thien to drink with them, but warned everyone: "Bring weapons for self-defense; if Thien attacks you, fight back." Hearing this, Tin, Xinh, and Tuan remained silent, showing no reaction, and went to the pub together. Seeing this, Tai went home, retrieved two homemade knives (machetes), and brought them to the pub, placing them under the table.

At Tài's invitation, Thiện went to the pub. However, without saying anything, Thiện suddenly grabbed a beer bottle from the table and hit Tín on the head before running away. Tài and Tín chased after Thiện with homemade knives in retaliation. Xinh and Tuấn also pursued them. After injuring Thiện, they all fled the area. Thiện was taken by his family to An Giang Central General Hospital for treatment and was discharged on April 18, 2022.

According to the forensic examination results, Thien's percentage of bodily injury from all his wounds was 23%. Seeing no way to escape, Tin and Tai successively surrendered to the police, confessing to their wrongdoing. Xinh and Tuan fled the area and have not been questioned since. Based on the initial investigation results, on October 10, 2024, the Criminal Investigation Department of the Long Xuyen City Police issued a decision to prosecute and detain Tai and Tin for further investigation.

Following the investigation, both defendants were brought to trial at the Long Xuyen City People's Court. Before the panel of judges, the defendants confessed that they initially only wanted to talk to Thien. However, when they arrived, Thien attacked first. Outraged by Thien's actions, the two defendants chased after him and attacked him to vent their anger, unaware of the serious consequences. The panel of judges determined that both defendants were healthy and capable of understanding and controlling their actions. However, due to their thuggish nature, disregard for the lives and health of others, and contempt for the law, the two defendants used dangerous weapons to inflict injuries on the victim.

However, the victim Thien also bears some responsibility for the incident. When Tai invited him to a reconciliation meeting, although he agreed, Thien attacked Tin first. After considering all the details of the case, the People's Court of Long Xuyen City sentenced Tai to 3 years in prison and Tin to 2.5 years in prison, both for the crime of "Intentional Infliction of Injury," as stipulated in Clause 2, Article 134 of the Penal Code; and recognized the compensation agreement between the two parties. Furthermore, it has not yet been determined whether Xinh and Tuan committed any violations. The Long Xuyen City Police Investigation Department decided to separate this into a different case, searching for Xinh and Tuan to clarify their roles and actions, and will handle their cases later.
