REGULATIONS ON POSTING AND PLAYING FOREIGN INFORMATION CONTENT IN THE PRESS
Base Press Law June 05, 4;
Based decree 72 / 2013 / ND-CP July 15, 7 of the Government on management, provision, and use of Internet services and online information and Decree No. 27 / 2018 / ND-CP November 01, 3 of the Government amending and supplementing a number of articles of Decree No. 72 / 2013 / ND-CP July 15, 7 on management, provision, and use of Internet services and online information;
Based decree 72 / 2015 / ND-CP September 07, 9 of the Government on management of foreign information activities;
Based decree 09 / 2017 / ND-CP February 09, 02 of the Government on detailed regulations on speaking and providing information to the press by State administrative agencies;
Based decree 17 / 2017 / ND-CP February 17, 02 of the Government regulating the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
At the request of the Director of the Department of Foreign Information,
The Minister of Information and Communications promulgates a Circular regulating the posting and broadcasting of foreign information content in the press.
GENERAL RULES
This Circular regulates the content of foreign information in the press; posting and broadcasting foreign information content in the press; rights and responsibilities of press agencies, responsibilities of relevant organizations and individuals in posting and broadcasting foreign information content in the press.
Article 2. Subject of application
This Circular applies to press agencies and press managing agencies; Information and communication facilities; Agencies, organizations and individuals involved in publishing and broadcasting foreign information content in the press.
In this Circular, the terms below are construed as follows:
1. Foreign press are print newspapers, electronic newspapers, foreign radio and television channels approved by the Prime Minister in the Foreign Press Planning.
2. The press publishes and broadcasts foreign information content means print newspapers, electronic newspapers, radio channels, and television channels, excluding foreign press as specified in Clause 1 of this Article.
Article 4. Content of foreign affairs information in the press
The content of foreign affairs information in the press includes official information about Vietnam, information promoting Vietnam's image, information about the world situation in Vietnam and information explaining and clarifying regulations in Clause 1 of Articles 7, 8, 9, 10 of Decree No. 72/2015/ND-CP dated September 07, 9 of the Government on management of foreign information activities.
Article 5. Principles for posting and broadcasting foreign information content in the press
1. Post and broadcast information content in accordance with the Party's guidelines and policies, the State's policies and laws, and in accordance with the interests of the country and the Vietnamese people.
2. Do not post or broadcast information that negatively affects the position and image of Vietnam; causing harm to foreign relations and international cooperation between Vietnam and other countries; inciting violence, propagandizing wars of aggression, causing hatred between nations and people of other countries.
REQUIREMENTS FOR POSTING AND PLAYING FOREIGN INFORMATION CONTENT IN THE PRESS
1. For information about important issues of Vietnam and the world: After receiving the views of the State of Vietnam provided by competent authorities, posting and broadcasting are carried out as follows:
a) Posting and broadcasting location: Front page for print newspapers; home page for electronic newspapers; news bulletins for foreign radio and television channels;
b) Posting and broadcasting time: No later than 02 hours for electronic newspapers; 05 hours for electronic newspapers that must be translated; 24 hours for print media; broadcast on the next news bulletin for foreign radio and television channels.
2. For explanatory and clarifying information: Post and broadcast in an easily accessible location, at the earliest possible time.
3. For other foreign information contents specified in Article 4 of this Circular: Post and broadcast at the same time of day.
4. Language expressed in Vietnamese and foreign languages:
a) Increase the number of news, articles, and programs produced in foreign languages (without going through the translation process) for publication and broadcast in the press;
b) Actively increase the number of languages expressed in foreign languages to serve foreign information audiences in different countries, with a focus on developing languages in key areas of foreign information according to each period.
Article 7. For the press, posting and broadcasting foreign information content
When posting or broadcasting foreign information content, encourage:
1. Post and broadcast promptly and in an easily accessible location.
2. Post and broadcast information about the Vietnamese State's stance on domestic and international issues as soon as possible or at the request of a competent State agency.
3. Post and broadcast news, articles, and programs with foreign information content in foreign languages or subtitles in foreign languages to promote the effectiveness of foreign information information.
4. Local radio and television stations:
a) Organize the rebroadcast of foreign information content broadcast on national radio and television stations on the basis of agreement between press agencies on the need for posting and broadcasting;
b) Provide local information content to post and broadcast in the foreign press to promote the local image to the world.
Chapter III
RIGHTS AND RESPONSIBILITIES OF RELATED UNITS
Article 8. Rights and responsibilities of the foreign press
1. Rights of the foreign press:
a) Receive priority from the State in placing orders for posting and broadcasting foreign information content in the press;
b) The State creates favorable conditions to publish and broadcast foreign information content in Vietnamese newspapers and foreign media.
2. Responsibilities of the foreign press:
a) Establish specialized pages and sections (for print and electronic newspapers), program groups and topics (for radio and television channels) on foreign information content;
b) Ensure there are reporters and editors monitoring foreign information;
c) Coordinate and share news, articles, and programs invested by the State with press agencies, organizations, and media at home and abroad;
d) Actively post and broadcast news, articles, radio and television programs promoting Vietnam's image on foreign media and newspapers of Vietnamese people abroad;
d) Encourage selection of news, articles, radio and television programs about foreign information to post and broadcast on social networks, ensuring intellectual property rights and principles of management, provision and use. Use online information according to the provisions of law;
e) Summarize, propose rewards, and report on the results of implementing foreign information content in the press, sending it to the Ministry of Information and Communications before November 30 every year or upon request (according to form specified in Appendix issued together with this Circular).
Article 9. Rights and responsibilities of the press to publish and broadcast foreign information content
1. Rights of the press to publish and broadcast foreign information content:
a) Being ordered by the State to post and broadcast foreign information content in the press;
b) The State creates favorable conditions to publish and broadcast foreign information content in the Vietnamese press.
2. Responsibilities of the press for posting and broadcasting foreign information content:
a) Positive information about the country and people of Vietnam in all fields;
b) Encourage the opening of specialized pages, sections, and topics to increase the effectiveness of foreign information information and protect sovereignty over seas, islands, borders, and national territory;
c) Assign reporters and editors to monitor foreign affairs information;
d) Organize summarizing, recommending rewards, and reporting on the results of implementing foreign information content in the press upon request.
Article 10. Responsibilities of press managing agencies
1. Direct and promote press agencies to publish and broadcast foreign information content in the press according to the provisions of this Circular.
2. Provide financial support (if any) for the press to publish and broadcast foreign information content.
Article 11. Responsibilities of the Department of Information and Communications
1. Direct and inspect the posting and broadcasting of foreign information content in local newspapers.
2. Summarize and report the results of implementation of the regulations in this Circular to the Ministry of Information and Communications upon request.
Article 12. Responsibilities of units under the Ministry of Information and Communications
1. The Department of Foreign Information is responsible for:
a) Monitor the implementation of regulations in this Circular; preside over and coordinate with units under the Ministry of Information and Communications to inspect the implementation of the regulations in this Circular; summarize the results and report to the Minister of Information and Communications;
b) Evaluate the effectiveness of press agencies' posting and broadcasting of foreign information content;
c) Providing information, organizing training and fostering professional skills in foreign information;
d) Coordinate with relevant agencies to develop mechanisms and policies to support the development of foreign journalism.
2. The Press Department is responsible for coordinating and monitoring the implementation of the regulations in this Circular for print and electronic press agencies.
3. The Department of Radio, Television and Electronic Information is responsible for coordinating and monitoring the implementation of the regulations in this Circular for radio and television stations.
TERMS ENFORCEMENT
Article 13. Responsible for implementing
Chief of Office, Director of the Department of Foreign Information, Heads of relevant agencies and units under the Ministry of Information and Communications; Director of the Department of Information and Communications, leaders of press agencies and relevant agencies, organizations and individuals are responsible for implementing this Circular.
1. This Circular takes effect from August 21, 6.
2. During the implementation process, if there are any problems that need to be amended or supplemented, agencies, organizations and individuals should promptly report them to the Ministry of Information and Communications for consideration and adjustment./.
