Should teachers be banned from giving online tutoring?

Many teachers, parents, and students are questioning whether online tutoring activities that charge fees violate the regulations of Circular 29/2024 of the Ministry of Education and Training.


Schools nationwide have suspended extracurricular tutoring activities in accordance with Circular 29/2024, and many extracurricular tutoring centers are also rushing to complete the necessary business registration procedures to resume operations.

In Circular 29/2024, the Ministry of Education and Training clearly defines "extra teaching and learning as additional teaching and learning activities beyond the time allotted in the educational plan for subjects and educational activities in the general education program, the continuing education program at the lower secondary level, and the continuing education program at the upper secondary level issued by the Minister of Education and Training".

The Circular does not specify which form of tutoring online tutoring falls under. However, whether teaching in person or online, it is considered tutoring and must comply with regulations.

According to Article 4 of Circular 29/2024, teachers currently teaching at schools may participate in extracurricular tutoring, but they are not allowed to provide paid tutoring to students enrolled in regular school classes. Furthermore, teachers on the payroll are not permitted to engage in business activities.

Therefore, teachers are only allowed to participate in extracurricular tutoring at licensed facilities and are not permitted to manage, organize, or operate extracurricular tutoring outside of school. Furthermore, whether teaching in person or online, teachers are not allowed to organize extracurricular tutoring for primary school students, except for training in arts, sports , or life skills.

In cases where teachers violate regulations regarding tutoring and supplementary classes, they will be dealt with according to the law, depending on the nature and severity of the violation.

Responsibilities of tutors

Article 14 of Circular 29/2024 clearly stipulates the responsibilities of teachers when participating in extracurricular teaching activities as follows:

  • Implement the regulations on supplementary teaching and learning as stipulated in this Circular and other relevant legal provisions.
  • Managing and ensuring the quality of supplementary tutoring and the rights of students and tutors; managing and using tuition fees for supplementary tutoring in accordance with regulations.
  • Manage and maintain records of tutoring and supplementary education organizations in accordance with regulations.
  • Report and explain the implementation of the regulations in this Circular and other relevant legal provisions to competent authorities when requested.
  • Receiving and processing feedback, suggestions, and requests from students and their parents regarding extracurricular tutoring before and during the implementation process.

In addition, the Circular increases the management responsibility of the Principal over teachers participating in extracurricular tutoring. Specifically, teachers who provide extracurricular tutoring must report to the Principal about the subject, location, format, and time of the tutoring.
