Specifically, in Official Document No. 1927, the Provincial People's Committee directed: "Only allow the conversion of land use purpose to residential land for plots located within existing residential areas, meeting the infrastructure conditions of the area, conforming to the land use plan, annual land use plan of the district level, zoning plan, detailed construction plan (for urban areas) or rural residential area plan (for rural areas) approved by competent state agencies...".
Speaking with a reporter from the Nguoi Lao Dong newspaper, Mr. Nguyen Van Thuan, Vice Chairman of the People's Committee of Khanh Vinh district, said that many difficulties have arisen in implementing this document. For example, Khanh Vinh town only has a detailed 1/500 scale planning map, while other communes do not. In reality, many cases of land plots requesting a change of land use purpose from agricultural land to residential land, even though they are consistent with the district's annual land use plan, cannot be converted because a detailed construction plan has not yet been prepared.

For other communes, only the new rural planning has been completed, but not the rural residential area planning, so they do not meet the prescribed conditions. "This is a common situation, not just in Khanh Vinh. We have submitted a document clearly stating the current situation and requesting the Khanh Hoa Provincial People's Committee and relevant departments and agencies to take action," Mr. Thuan said.
According to local authorities, the preparation of zoning plans, detailed construction plans, and rural residential area plans covering the entire district requires a specific timeline, funding, and considerable time. While awaiting approval of these plans by competent state agencies, local authorities request that the Department of Natural Resources and Environment advise the Provincial People's Committee to promptly issue specific guidelines on the consideration and processing of applications for land use conversion to residential land. This aims to streamline administrative procedures and meet the legitimate needs of land users in accordance with the law, thereby facilitating land management and socio-economic development in the locality.
According to a report from the Department of Natural Resources and Environment of Khanh Hoa province, during the implementation of the directives from the Provincial People's Committee in the aforementioned document, most localities encountered difficulties related to the application of construction plans when processing applications for land-use conversion for residential land. The reason is that currently, localities have not been able to fully cover all zoning plans, detailed construction plans, and rural residential area plans across all districts, towns, and cities.
The aforementioned difficulties faced by localities stem from practical situations and are largely due to limitations in the planning work of state agencies, which have significantly affected the legitimate rights and interests of land users as stipulated by law. To address these issues, the Department of Natural Resources and Environment has submitted a document requesting the Provincial People's Committee to consider revoking Document No. 1927. Simultaneously, it has assigned the People's Committees of districts, towns, and cities to handle applications for land use conversion for households and individuals in accordance with their authority and legal regulations, and to take responsibility for land management and construction order in their localities.
