Specifically, in Official Dispatch No. 1927, the Provincial People's Committee directed: "Only allow the conversion of land use purpose to residential land for plots of land located in existing residential areas, meeting the regional infrastructure conditions, in accordance with land use planning, annual land use plans of the district level, zoning planning, detailed construction planning (for urban areas) or rural residential planning (for rural areas) approved by competent state agencies...".
Speaking to a reporter from Nguoi Lao Dong Newspaper, Mr. Nguyen Van Thuan, Vice Chairman of Khanh Vinh District People's Committee, said that many problems arose when implementing this document. For example, Khanh Vinh town only has a detailed 1/500 plan, while other communes do not. In fact, many land plots have requested to change their purpose of use from agricultural land to residential land, even though they are in accordance with the annual district-level land use plan and planning, but have not yet established a detailed construction plan, so they cannot be converted.

For other communes, there is only new rural planning, not yet rural residential planning, so it does not meet the prescribed conditions. "This is a common situation, not just Khanh Vinh. We have issued a document stating the current situation and requesting the Khanh Hoa Provincial People's Committee, departments and branches to have a solution" - Mr. Thuan said.
According to localities, the establishment of zoning plans, detailed construction plans, and rural residential area plans covering the entire district requires a roadmap, funding sources, and will take a lot of time. While waiting for the above plans to be approved by competent state agencies, localities request the Department of Natural Resources and Environment to advise the Provincial People's Committee to soon issue specific instructions on considering and handling dossiers for converting land use purposes to residential land to resolve administrative procedures and meet the legitimate needs of land users in accordance with legal regulations; creating favorable conditions for land management and socio -economic development of the locality.
According to the report of the Department of Natural Resources and Environment of Khanh Hoa province, in the process of implementing the direction of the Provincial People's Committee in the above document, most localities have encountered difficulties related to the application of construction planning when handling records of land use purpose conversion for residential land. The reason is that localities are currently unable to cover all zoning plans, detailed construction plans, and rural residential area plans in all districts, towns, and cities.
The above difficulties of localities are derived from practical situations and are mainly caused by limitations in planning work of state agencies, which have significantly affected the legitimate rights and interests of land users according to the provisions of law. To resolve these issues, the Department of Natural Resources and Environment has issued a document requesting the Provincial People's Committee to consider and cancel Official Dispatch No. 1927. At the same time, assign the People's Committees of districts, towns and cities to handle the dossiers of change of purpose of households and individuals according to their authority and provisions of law and take responsibility for land management and construction order in the locality.
