What did Da Lat report regarding the violations at Doi Cu Hill?

On the afternoon of January 12th, the People's Committee of Da Lat City submitted a report to the People's Committee of Lam Dong Province regarding the construction of a golf club by Hoang Gia Da Lat Joint Stock Company on Cu Hill.

Regarding this project, on April 25, 2023, the People's Committee of Ward 1 (Da Lat) coordinated with the City's Urban Management Department to inspect the construction of the golf club building and discovered and documented numerous violations.

Two golf club buildings were constructed illegally and without permits on Cu Hill.

Accordingly, Da Lat City noted that this project was granted construction permit No. 02/GPXD dated January 12, 2023, by the Department of Construction of Lam Dong Province, allowing Hoang Gia DL Joint Stock Company to construct a portion of the basement of Block 1 with a total floor area of ​​2,639 ^m² . However, the investor constructed one basement, one ground floor, and one upper floor. The area of ​​violation amounts to 3,333 ^m² .

In addition, with two buildings constructed without building permits (each with 2 basements, 1 ground floor, and 2 upper floors), the total area of ​​violations amounts to 20,406 ^m² .

According to the Da Lat City People's Committee, on November 9, 2023, the Lam Dong Department of Construction issued Decision No. 170/QD-SXD and Notice No. 2782/TB-SXD regarding the inspection of compliance with construction regulations at the golf club building of Hoang Gia DL Joint Stock Company, but did not coordinate with the Da Lat City People's Committee to conduct the inspection.

On November 10, 2023, Hoang Gia DL Joint Stock Company issued document No. 69/HGDL requesting a postponement of the inspection of the investment and construction of the golf club building.

Block 2 of the golf club building was constructed without a permit.

On November 18, 2023, the People's Committee of Ward 1, in coordination with the Urban Management Department, continued to inspect and re-examine the compliance with the construction suspension order. During the inspection, the team requested Hoang Gia DL Joint Stock Company to strictly comply with the construction suspension order and implement the measures outlined in the commitment letter established on April 26, 2023.

Regarding the violations at Doi Cu in Da Lat, the Da Lat City People's Committee issued two decisions imposing fines totaling 240 million VND. Meanwhile, on January 11th, the Lam Dong Provincial People's Committee issued a document requesting Hoang Gia Da Lat Joint Stock Company to voluntarily dismantle the illegally constructed and unauthorized structures.

The handling of the construction violations has been directed by the Da Lat City People's Committee to the Urban Management Department and the People's Committee of Ward 1, in accordance with the authority and responsibilities delegated by the Provincial People's Committee in Decision No. 31/2022/QD-UBND dated May 16, 2022, of the Lam Dong Provincial People's Committee, which promulgates regulations on construction order management, decentralization of construction order management, and receiving notices of commencement of construction along with construction design documents in the area.

Regarding the delay in processing the violation report for construction regulations by Hoang Gia DL Joint Stock Company, the People's Committee of Da Lat City cited the reason that Ms. Le Thi Hong Xuan (residing on Yersin Street, Ward 1, Da Lat City, the legal representative) was not present in the locality at the time of inspection, guidance, and processing of the violation report after April 2023 (on business trip outside the province) and did not have a power of attorney as required by law, thus prolonging the processing of the violation.

At the same time, identifying construction violations requires accurately determining the specific items and acts of violation to avoid duplication in the handling of violations by relevant authorities.
