Vice Chairman of the People's Committee of Bac Giang province, Le O Pich, has just signed Decision No. 24/2024 detailing the land allocation limits for residential land, the land recognition limits for residential land; the minimum area and conditions for land subdivision and consolidation, and other issues related to land transfer and conversion of land use purposes.

Residential land must have a minimum area of ​​32m2 in the wards of Bac Giang City and in urban residential land in towns, towns that have been converted into wards, and in the cities. In addition, a minimum area of ​​50m2 is required in communes within the administrative boundaries of districts and towns that have been converted into wards or towns due to new establishment.

The minimum frontage size is 4m, and the depth from the building line, if any, must be at least 5.5m, for original plots with an existing depth of 5.5m or more. For plots of land acquired by the State, if the existing depth is less than 5.5m, the minimum depth must be 3m.

For residential land not falling under the above cases, the subdivided plot must have a minimum residential land area of ​​70m2. The minimum frontage is 4m, and the minimum depth from the building line, if any, is 8m for original plots with an existing depth of 8m or more.

In cases where the land plot is reclaimed by the State and its existing depth is less than 5.5m, the minimum depth must be ensured to be 5m.

If the land plot is allocated or leased by the State for the implementation of an investment project, then the land plot must be subdivided according to the approved project in accordance with the law on investment.

According to Decision 24 of the People's Committee of Bac Giang province, the maximum land allocation limit for individuals in urban areas of Bac Giang city's wards (excluding cases where communes within the administrative boundaries of districts and towns are converted into wards or townships due to new establishment, division, or merger of administrative boundaries) is 100m2.

Residential land in urban areas includes land in towns, land in towns that have been converted into wards; residential land in wards of Viet Yen town; residential land in the communes of Dinh Tri, Song Khe, Tan Tien, Dong Son, Tan My, and Song Mai in Bac Giang City; residential land in communes within the boundaries of Bac Giang City that have been converted into wards; and residential land in rural areas adjacent to expressways, national highways, and provincial roads, with a maximum area of ​​120m2.

Meanwhile, residential land in communes within the administrative boundaries of districts and towns that have been transformed into wards or townships due to new establishment, division, or merger of administrative boundaries (after the Resolution of the Standing Committee of the National Assembly on new establishment, division, or merger of administrative boundaries takes effect) is capped at 200m2.

Residential land in midland communes of districts, cities, and towns is limited to a maximum of 300m2. Residential land in mountainous communes of districts and towns is limited to a maximum of 360m2.

If the land plot was formed before December 18, 1980, the residential land area is determined by 5 times the residential land allocation limit corresponding to each region and area, but not exceeding the area of ​​the land plot currently in use, and a maximum of 800m2.

For land plots formed between December 18, 1980, and before October 15, 1993, the recognized residential land limit is determined by three times the residential land allocation limit corresponding to each region and area, but the total area must not exceed the area of ​​the land plot currently in use, with a maximum of 600m2.

According to the People's Committee of Bac Giang province, Decision 24/2024 officially came into effect on September 21st, replacing Decisions 40/2021 and 44/2023 of the province.
