No disciplinary action will be taken against party members for having a third child.

(NLDO) - According to new guidelines from the Central Disciplinary Committee , Party members who have a third child or more will no longer be subject to disciplinary action.


The Central Disciplinary Committee recently issued Guideline 15, amending and supplementing Guideline 05 on the implementation of Political Bureau Regulation 69, concerning the disciplinary action against Party organizations and members who violate regulations. This guideline takes effect from March 20th.

According to the new guidelines from the Central Inspection Commission, points 8.1 and 8.2 of section III in Guideline 05 have been omitted. These points stipulated the consideration and handling of disciplinary actions for violations of population policy, including having a third child or more.

The new guidelines also add point 8.3, which states: "No action will be taken against the act stipulated in Clause 2, Article 1 of Ordinance No. 08/2008/PL-UBTVQH12 dated December 27, 2008, amending Article 10 of the 2003 Population Ordinance, 'Having one or two children, except in special cases as prescribed by the Government '."

With this change, from March 20th, party members who have a third child or more will no longer be subject to disciplinary action. Having a third child is also no longer considered a violation subject to disciplinary action by the Party.

This is a concrete step in implementing the Politburo's directive in document No. 13421 dated February 17, following the review of seven years of implementing Resolution No. 21 on population work in the new situation.

Previously, at the meeting on February 14th, the Politburo considered the proposal of the Central Inspection Committee to review Party regulations related to handling violations of population policy, and the report of the Party Committee of the Ministry of Health on the 7 years of implementing Resolution 21 of the 12th Central Committee.

The Politburo assigned the Central Inspection Committee to advise on and amend the regulations of the Central Committee, the Politburo, and the Secretariat related to handling violations of population policy, and to proactively revise Guidance No. 05 dated November 22, 2022, of the Central Inspection Committee, in the direction of not imposing disciplinary measures on cases of having a third child or more.

Not applying disciplinary measures retroactively to cases that have already been dealt with is also a policy agreed upon by the Politburo.

Previously, the Ministry of Health submitted a proposal to the competent authorities to abolish outdated regulations on handling violations of population policy, initially abolishing penalties for violations related to the number of children.

According to the Ministry of Health, Vietnam's fertility rate is among the top 5 lowest in Southeast Asia. Specifically, the national fertility rate is trending downwards, falling below the replacement level, from 2.11 children per woman in 2021 to 2.01 in 2022.

This index continued to fall, reaching 1.96 children per woman in 2023 and 1.91 in 2024 – the lowest in history – and is projected to continue declining in the following years.
