Concerns about speculation and soaring land prices.

Kinhtedothi - During group discussions, National Assembly representative Nguyen Phuong Thuy ( Hanoi City National Assembly Delegation) expressed concern that the land price surge would spread if the land fund for commercial housing were expanded.


Land prices are skyrocketing, increasing at an astronomical rate.

On November 13th, during a group discussion on the Draft Resolution on piloting commercial housing projects through agreements on land use rights or existing land use rights, National Assembly representative Nguyen Phuong Thuy (Hanoi City National Assembly Delegation) stated that land prices are skyrocketing, especially after auctions in suburban districts, and there are no solutions to control this.

Regarding the pilot program allowing the expansion of agricultural and non-agricultural land (commercial, service, etc.) for commercial housing projects through agreements, Representative Nguyen Phuong Thuy expressed concern that the land price surge would spread, creating barriers for businesses needing to use and access land resources.

"If organizations or individuals buy up land to convert it into commercial housing, land prices will increase, making access to land even more difficult. Therefore, this pilot program should only be implemented in large urban areas with high housing demand, such as Hanoi and Ho Chi Minh City," said representative Nguyen Phuong Thuy.

National Assembly representative Ha Sy Dong (Quang Tri province delegation) expressed concern that if the pilot program is ineffective, it will lead to land profiteering, speculation, and land accumulation. This would negatively impact real estate prices.

"Hanoi and Ho Chi Minh City are major cities or localities with many stalled projects, so priority should be given to projects that meet actual needs. At the same time, procedures must be simplified to avoid the emergence of a 'request-and-grant' mechanism that creates difficulties for investors," said National Assembly representative Ha Sy Dong.

Adding new approaches to land access in commercial housing development.

Meanwhile, National Assembly representative Tran Hoang Ngan (Ho Chi Minh City National Assembly delegation) argued that piloting this policy would have a ripple effect in supporting the socio-economic development of the country, especially in removing difficulties in the construction of commercial housing, creating favorable conditions for land users and investors to proactively implement commercial housing projects and urban development projects, contributing to solving the housing needs of the people.

During the group discussion, Minister of Natural Resources and Environment Do Duc Duy explained that, according to Resolution 18-NQ/TW dated June 16, 2022, of the 13th Central Committee of the Communist Party of Vietnam "on continuing to innovate and improve institutions and policies, enhance the effectiveness and efficiency of land management and use, and create momentum to make Vietnam a high-income developed country," land allocation and leasing are carried out through auctioning the right to use and bidding. Therefore, the form of receiving the transfer of land use rights or changing the purpose of land currently in use is an additional form, and the Government proposes a maximum of 30% of the land area to be implemented through this method. The remaining 70% of the project area must be implemented through bidding and auctioning according to Resolution 18-NQ/TW. The essence of this pilot expansion of land use is to supplement the forms of land access for commercial housing projects.

Responding to concerns from delegates about overlap with the 2024 Land Law, the Minister of Natural Resources and Environment stated that the Government has added a clause to the draft resolution to avoid this duplication. That is, any case already covered by the 2024 Land Law will be excluded from the scope of this resolution.

According to the agenda, the National Assembly will discuss in the plenary session the Draft Resolution on piloting the implementation of commercial housing projects through agreements on land use rights or existing land use rights on November 21st, and will pass it at the end of the 8th Session.
