Deadlock when failing vehicle inspection
Mr. LV, residing in Thu Duc City (HCMC), owner of a Mercedes C250 with license plate 66A-024.xx, said: "At 1:00 p.m. on May 17, 2023, I drove my car to the Motor Vehicle Inspection Center No. 50-05V, Hong Ha branch, HCMC to have my car inspected according to the appointment code 5005VCN117051124006. My car has all the documents and is original according to the law. Inspector TVP is the person in charge of inspecting my car. After checking all the items, when it came to taking photos of the car, inspector P. called me back and informed me that the grille of my car had been replaced and was not in accordance with the technical documents of the car when it left the factory.
Businesses and individual car owners are looking forward to an automatic inspection renewal solution.
I explained to the inspector that the Mercedes C250 (W205) has 2 versions sold by Mercedes to users: One version is C250 AMG like the image in the file on the inspection system that the inspector printed and gave me; one version is C250 Exclusive like the car I am using. The TVP inspector told me that this car has a front grille, will not handle the inspection, return the file to me and force me to change the front grille and bumper to the C250 AMG version before I can come back for inspection again.
That same afternoon, I contacted Mercedes-Benz and asked them to check my car's VIN number to show that my car's grille was Exclusive. Then, I returned to the center to show the Mercedes C250 (W205) model with 2 versions, AMG and Exclusive, and the verification image that my car's grille was original, without any modifications. However, the TVP inspector still confirmed that my car was in violation, refused to register it, and returned the file to me to fix the car."
Mr. LV affirmed: "My car is in accordance with the original manufacturer's specifications. Since the time of purchase, it has always been maintained and no parts have been replaced or modified that affect the size and safety of the car. Now, when going for vehicle inspection according to state regulations, the inspectors force citizens to change their vehicles from right to wrong, causing inconvenience to the people. Suppose my car has changed the front grille but not the size of the car, my car is still eligible for inspection and does not violate any regulations and is not subject to inspection. In this case, my car has not changed any parts that affect the size or safety of the car. My car is in accordance with the original design of the manufacturer. Even the 50-05V Hong Ha Inspection Center advised me to bring the car back to the 66-01S Center, where the inspection certificate was issued in the previous period, for inspection."

Queuing up to get a spot for inspection is already difficult, failing the inspection due to "oh my god" errors is even more difficult to find a way to fix it. A representative of Dat Cang Hai Phong Taxi Company reflected: "As of May 18, hundreds of Dat Cang Hai Phong Taxi vehicles are being parked because the vehicles cannot be inspected due to the error of "paint color not matching the vehicle registration certificate". For many years, Dat Cang Taxi has designed a logo with its own color (royal poinciana color) to create brand recognition (accounting for less than 30% of the original paint color of the vehicle) and also according to the previous regulations of the Ministry of Transport, taxi vehicles of each company must register their own paint color. However, this company is currently unable to get the inspection because the vehicle registration is white but has a red tint on the vehicle.
"For nearly 20 years, the business has been operating normally, and vehicles have not encountered any difficulties when they are inspected. Now it is too difficult to overload the vehicles until they are due for inspection, but they are not inspected because of an unexpected error. Now the business has to stop operating hundreds of vehicles due to not being inspected. Workers are out of work, customers miss their trips, and leaders have a headache not knowing how to comply with regulations," said Mr. Vu Anh Tuan, Director of Dat Cang Hai Phong Taxi Company.
Exhausted by too many burdens
To remove difficulties for businesses and people in vehicle inspection, on December 28, 2022, the Vietnam Register issued Document No. 5300/ĐKVN-VAR stipulating that items assessed as unimportant defects and damages that do not affect safety and environmental protection will still be granted inspection certificates. Specifically, vehicles "not in the same paint color as stated in the vehicle registration certificate" will still be granted inspection certificates. However, according to the inspection content, inspection method and defects and damages issued with Circular No. 02/2023/TT-BGTVT dated March 21, 2023, "not in the same paint color as stated in the vehicle registration certificate" is considered an important defect or damage. In fact, many vehicles are now decaled or painted by owners, especially transport vehicles to identify the brand. Therefore, if following the above regulations, many transport vehicles are not eligible for inspection.
Mr. ML, the owner of a transport company in Ba Ria-Vung Tau, lamented: "For more than half a year now, the vehicle inspection situation has been congested, making appointment registration difficult, my company itself has 6 vehicles that are past the inspection deadline because their appointment was suddenly canceled. But the difficulty that has arisen recently is that some vehicles have been fined but neither the driver nor the company knows, they are only notified when they go for inspection. When this error occurs, the vehicle owner must pay the fine and wait a few days for the traffic police to delete the error on the system and update it before the inspection department accepts it."
"It is worth mentioning that before going to the vehicle inspection, we carefully checked the website but still did not detect any fines. Thus, the negligence was not on the part of the business but rather a problem with the management agency's data system. To be more precise, currently, most people search for fine information on their own according to instructions online, but there is no standard application from the vehicle inspection or traffic police," Mr. ML reflected.
Speaking to Thanh Nien reporter, Mr. Nguyen Van Hung, Vice President of Binh Duong Transport Association, confided: "We have heard many solutions being proposed to quickly help transport businesses escape difficulties, but up to now many businesses are still at a standstill."
According to Mr. Nguyen Van Hung, the management agency needs to quickly implement the proposed solutions such as automatically extending the inspection cycle for non-business vehicles, reducing congestion for motor vehicles. Recently, many negative incidents have occurred in vehicle inspection, causing the inspection to be tightened. Common cases that are currently denied inspection include: Modifying the grille, logo, installing additional front and rear bumpers, roof racks, modifying car lights, installing additional seats, changing the paint color, changing the vehicle structure, and not complying with the requirements for installing a journey monitoring device. However, some people wonder if modifying the grille or logo is only for aesthetic purposes, does not affect the technical safety of the vehicle... but still fails the inspection, so more specific instructions are needed to avoid causing more trouble for the people.
"After 2 years of the pandemic, with the high price of gasoline and oil, and now the economic recession, businesses are under pressure from bad debt, bank loan interest... With the prolonged difficulty in vehicle inspection like this, many transport businesses will certainly be exhausted and unable to bear it," said Mr. Hung.
