Stuck in a rut after failing the vehicle inspection.

Mr. LV, residing in Thu Duc City (Ho Chi Minh City), owner of a Mercedes C250 with license plate 66A-024.xx, stated: "At 1 PM on May 17, 2023, I drove my car to the Motor Vehicle Inspection Center No. 50-05V, Hong Ha branch, Ho Chi Minh City, to have it inspected according to appointment code 5005VCN117051124006. My car had all the necessary documents and was in its original condition, in accordance with the law. Inspector TVP was in charge of inspecting my car. After checking all items, during the photo-taking phase, inspector P. called me back and informed me that the front grille of my car had been replaced and did not match the technical specifications of the car when it left the factory."

Businesses and individual vehicle owners alike are eagerly awaiting a solution that automatically renews vehicle inspection certificates.

I explained to the vehicle inspector that the Mercedes C250 (W205) has two versions sold by Mercedes: one is the C250 AMG, as shown in the image in the registration file that the inspector printed and gave me; the other is the C250 Exclusive, like the car I am currently using. The TVP inspector told me that this car had a different grille, therefore the registration would not be processed, and returned my documents, forcing me to change the grille and bumper to match the C250 AMG version before I could re-register it.

That same afternoon, I contacted Mercedes-Benz and asked them to check my car's VIN to ensure that my grille was indeed the Exclusive version. Then, I returned to the aforementioned center to provide images showing that my Mercedes C250 (W205) has two versions, AMG and Exclusive, along with images verifying that my grille was original and not modified. However, the TVP inspection officer still insisted that my car was in violation, refused to register it, and returned my documents, telling me to go back and have the car repaired."

Mr. LV asserted: "My car is completely original from the manufacturer. Since I bought it, I have always maintained it and have not replaced or modified anything that affects the size or safety of the vehicle. Now, during the vehicle inspection according to state regulations, the inspectors are forcing citizens to modify their vehicles in a way that is wrong, causing inconvenience to the people. Suppose my car had a modified grille but it didn't change the vehicle's dimensions, then my car would still meet the inspection requirements and wouldn't be considered a violation and would fail the inspection. In this case, my car hasn't had any parts changed that affect its size or safety; it's completely original according to the manufacturer's design. Even the 50-05V Hong Ha Inspection Center advised me to take my car to the 66-01S Center, the one that issued the previous inspection certificate, for inspection."

After two years of the pandemic, followed by soaring fuel prices, and now an economic recession, businesses are facing pressure from bad debts and bank interest rates… Adding to this the prolonged difficulties with vehicle inspections, many transportation businesses will surely be exhausted and unable to cope.

Waiting in line for a vehicle inspection is difficult enough, but failing the inspection due to "outrageous" errors is even harder to fix. A representative from Dat Cang Taxi Company in Hai Phong reported: "As of May 18th, hundreds of Dat Cang Taxi vehicles in Hai Phong are sitting idle because they cannot pass inspection due to the error of 'not matching the paint color stated in the vehicle registration certificate'. For many years, Dat Cang Taxi has had a logo design with its own unique color (phoenix flower color) to create brand recognition (only occupying less than 30% of the original paint color of the vehicle) and also according to previous regulations of the Ministry of Transport that taxis of all companies must register their own paint color. However, currently, this company cannot get the vehicles inspected because the registered color is white but there is a red tint on the vehicle."

"For nearly 20 years, the business has operated normally, and vehicle inspections have been trouble-free. Now, we're facing extreme difficulties due to the overwhelming workload, with vehicles being denied inspections simply because of unexpected errors. Hundreds of vehicles have had to cease operations because they can't be inspected. Employees are unemployed, customers are missing trips, and management is racking their brains trying to figure out what's right according to regulations," said Mr. Vu Anh Tuan, Director of Dat Cang Taxi Company in Hai Phong.

Exhausted by too many burdens.

To alleviate difficulties for businesses and individuals in vehicle inspection, on December 28, 2022, the Vietnam Registering and Inspection Department issued Document No. 5300/ĐKVN-VAR stipulating that items assessed as minor defects or damage that do not affect safety and environmental protection are still eligible for inspection certificates. Specifically, vehicles with "incorrect paint color as stated in the vehicle registration certificate" are still eligible for inspection certificates. However, according to the inspection content, inspection methods, and defects/damages issued with Circular No. 02/2023/TT-BGTVT dated March 21, 2023, "incorrect paint color as stated in the vehicle registration certificate" is considered a significant defect or damage. In reality, many vehicles, especially those used for commercial transport, have decals or decorative paint applied by their owners for brand identification. Therefore, if the above regulations are followed, many commercial transport vehicles will not meet the requirements for vehicle inspection.

Mr. ML, the owner of a transportation company in Ba Ria-Vung Tau, lamented: "For more than six months now, the vehicle inspection process has been constantly congested. Scheduling appointments has been difficult, and my company currently has six vehicles that are overdue for inspection due to sudden cancellations. A recent difficulty is that some vehicles have accumulated traffic violations without the driver or the company knowing, only being notified when they go for inspection. When a vehicle is found to have this violation, the owner has to pay the fine and wait several days for the traffic police to clear the violation from the system and update it before the inspection agency will accept it."

"Notably, before going for vehicle inspection, we carefully checked the website but still didn't find any traffic violations. Therefore, the oversight wasn't on the part of the business, but rather due to a problem with the management agency's data system. More precisely, currently, most people have to find information about traffic violations themselves by searching online, as there isn't a standardized application from the vehicle inspection agency or the traffic police," Mr. ML reflected.

Speaking to a reporter from Thanh Nien newspaper, Mr. Nguyen Van Hung, Vice Chairman of the Binh Duong Transport Association, confided: "We have heard many solutions being proposed to quickly help transport businesses overcome difficulties, but so far many businesses are still at a standstill."

According to Mr. Nguyen Van Hung, the management agency needs to quickly implement the proposed solutions such as automatically extending the vehicle inspection cycle for non-commercial vehicles and reducing traffic congestion for motor vehicles. Recently, many irregularities have occurred in vehicle inspection, leading to stricter inspection procedures. Common cases of vehicle rejection include: modifying the grille, logo, adding front and rear bumpers, roof racks, modifying headlights, adding seats, changing paint color, altering vehicle structure, and failing to comply with the requirement to install a vehicle tracking device. However, some people question why modifications to the grille or logo, which are purely aesthetic and do not affect the vehicle's technical safety, are still rejected during inspection. Therefore, more specific guidance is needed to avoid causing further inconvenience to the public.
