New regulations on immigration and emigration fees.
The Minister of Finance has issued Circular No. 28/2026/TT-BTC stipulating the rates, collection methods, and payment procedures for fees and charges in the fields of exit, entry, transit, and residence in Vietnam.
This Circular regulates the payers of fees and charges; the organizations collecting fees and charges; the rates, collection and payment procedures for fees and charges in the field of exit, entry, transit, and residence in Vietnam, including: fees for issuing passports, travel documents, exit permits, and "AB" stamps; fees for issuing visas and other documents valid for exit, entry, and residence for foreigners.
The fees and charges in the fields of exit, entry, transit, and residence in Vietnam are regulated as follows:

Visa issuance is based on the personnel review list of the immigration management agency for foreigners visiting or transiting by sea who wish to enter the country for sightseeing and tourism according to programs organized by international travel businesses in Vietnam; and for members of foreign military vessels participating in official activities of visits outside the province or centrally-governed city where the ship or vessel is anchored.

Cases that are exempt from fees.
According to the draft, the following cases are exempt from fees:
a) Guests (including spouses and children) invited by the Party, State, Government, National Assembly, or by leaders of the Party, State, Government, or National Assembly in their personal capacity;
b) Officials and employees of foreign diplomatic missions, consular offices, and representative offices of international organizations in Vietnam, and their family members (spouse and children under 18 years of age), regardless of passport type, who are not Vietnamese citizens and do not reside permanently in Vietnam, are exempt from fees on a reciprocal basis;
c) Cases where fees are waived according to international treaties that Vietnam has signed or participated in, or according to the principle of reciprocity;
d) Foreigners entering Vietnam to carry out relief work or provide humanitarian assistance to Vietnamese organizations or individuals;
d) Granting visas or temporary residence permits for foreigners in Vietnam who have violated the law and are subject to legal action, but who lack the financial means, and whose diplomatic mission refuses to cover the costs, or where there is no diplomatic mission of the country whose citizens have violated the law in Vietnam.
The determination of whether a foreigner in Vietnam who violates the law is eligible for free prosecution in this case is decided by the fee-collecting organization on a case-by-case basis and they are responsible according to the provisions of the law;
e) Granting special visa exemption cards to foreigners in accordance with the law on temporary visa exemption for foreigners who are eligible for special preferential treatment to serve socio-economic development;
g) Cases for reasons of security, foreign relations, international integration, or when there is a need to take advantage of opportunities, but not falling under the cases specified in points a, b, and c above.
Cases exempt from passport issuance fees include:
a1) Vietnamese citizens residing abroad who have a written deportation order from a competent authority in the host country but do not possess a passport;
b1) Vietnamese citizens residing abroad who must return to Vietnam in accordance with international treaties or agreements on the repatriation of citizens but who do not have passports, and in cases for humanitarian reasons.
The circular clearly states that the head of the fee-collecting organization decides on the application of fee exemptions in cases based on the principle of reciprocity as stipulated in points b and c above, and in cases stipulated in point g above.
Organizations collecting fees and charges must stamp "Fee Exempt" (except for the issuance of special visa exemption cards as stipulated in point e above) or "Fee Exempt" (GRATIS) on the issued documents for cases where fees and charges are exempted as stipulated above.
This Circular shall take effect from April 1, 2026./.
