Increase the deposit amount for land auctions to 50%.

(Chinhphu.vn) - The Government issued Resolution No. 66.11/2026/NQ-CP dated January 6, 2026, stipulating the handling of difficulties and obstacles in auctioning land use rights in cases of land allocation for residential purposes as prescribed by the Land Law.

The government has issued a resolution addressing difficulties and obstacles in auctioning land use rights in cases of land allocation for residential purposes.

This resolution stipulates the deposit required for participating in land use right auctions in cases of allocating residential land to individuals; and the handling of violations by those who win the land use right auction and violate their obligation to pay the winning bid price as prescribed by land law and other relevant laws.

Increase the deposit amount for land auctions.

The resolution stipulates several solutions and mechanisms to prevent profiteering and violations, including the abandonment of land auction deposits. Specifically, the resolution regulates the deposit required for participating in land use right auctions in cases where residential land is allocated to individuals as stipulated in the Land Law.

Article 39 of the Law on Auction of Assets 2016 (amended and supplemented in 2024) stipulates that, for auctioning land use rights to allocate residential land to individuals, the minimum deposit for participating in the auction is 5% and the maximum is 20% of the starting price.

The resolution stipulates that in the case of auctioning land use rights for residential land allocation to individuals as prescribed by the Land Law, the minimum deposit is 10% and the maximum is 50% of the starting price. Raising the deposit amount for land use right auctions is a solution to prevent the practice of bidding high for profit and then abandoning the deposit.

A successful bidder who fails to pay the winning bid will be banned from participating in auctions for up to 5 years.

At the same time, the Resolution also sets out specific regulations for handling violations by those who win the land use rights auction in the case of land allocation for residential purposes.

According to the Resolution, a person who wins the land use rights auction for residential land allocation and violates the obligation to pay the winning bid amount, resulting in the cancellation of the auction results, will be prohibited from participating in land use rights auctions for residential land allocation, depending on the nature and severity of the violation, as follows:

- From 2 to 5 years in the case where the winning bidder fails to pay the winning bid amount;

- From 6 months to 3 years in cases where the winning bidder fails to pay the full winning bid amount.

The authority that approves the results of the land use right auction for the allocation of residential land to individuals is the same authority that decides to prohibit participation in the auction as stipulated above.

Within 10 days from the date of issuing the decision to revoke the decision recognizing the results of the land use rights auction, the competent authority shall consider and issue a decision prohibiting the winning bidder from participating in the auction, in accordance with regulations.

The content of the decision prohibiting participation in the auction, the sending and posting of the decision prohibiting participation in the auction on the National Asset Auction Portal, the complaint, lawsuit, and statute of limitations for handling violations shall be implemented in accordance with the provisions of Clauses 3 and 4 of Article 25 and Article 26 of Government Decree No. 172/2024/ND-CP dated December 27, 2024, detailing a number of articles of the Law on Asset Auctions No. 01/2016/QH14, as amended and supplemented by Law No. 37/2024/QH15.

This resolution shall be in effect from January 6, 2026 to February 28, 2027.

In the event that laws, resolutions of the National Assembly , ordinances, or resolutions of the Standing Committee of the National Assembly are amended, supplemented, or newly enacted and take effect after the date this Resolution is adopted and before March 1, 2027, the corresponding provisions issued in this Resolution shall cease to be in effect.

During the period when the provisions of this Resolution are in effect, if the regulations on deposit money and prohibition from participating in land use right auctions in the case of land allocation for residential purposes in this Resolution differ from relevant legal documents, the provisions of this Resolution shall prevail.
