In reality, counterfeit goods are not limited to a few common consumer items but have become widespread in the production of food, pharmaceuticals, cosmetics, agricultural supplies, electronic components, and more. Counterfeit goods are directly harming public health, distorting the competitive environment, and undermining market trust; for now, a fake pill can threaten a patient's life, and a fake fertilizer product can cause farmers to lose their entire crop...
The Ministry of Industry and Trade is drafting a law to amend and supplement several articles of the Law on Commerce, the Law on Competition, the Law on Foreign Trade Management, and the Law on Consumer Rights Protection. In particular, the Ministry of Industry and Trade proposes regulations defining what constitutes "counterfeit goods" in the Law on Commerce to create a strong legal basis and enhance the effectiveness of the fight against the production and trade of counterfeit goods; and to protect the legitimate rights and interests of citizens and businesses.
The amendments and additions in the draft also show a clearer approach: combating counterfeit goods is not just a matter of purely market management, but also a requirement to protect public interests, security, and the health and safety of the people.
From a macroeconomic perspective, counterfeit goods reduce investment efficiency, erode the innovation drive of legitimate businesses, and create a less transparent business environment. In the context of Vietnam's goal of high growth, focusing on quality and sustainability, the persistent existence of counterfeit goods will become a major obstacle to national competitiveness.
However, tightening market discipline does not mean creating more uncontrolled "administrative barriers." The important thing is that the measures are designed with clear authority, transparent procedures, and accountability for the implementing agencies. Inspections must be focused, and penalties must be fair, avoiding situations where the weak are treated harshly and the strong are treated leniently, or where management tools become a burden for businesses complying with the law.
This spirit is also consistent with the requirements set forth in the Party's 14th Congress document: a strong shift from "issuing policies" to "organizing implementation," overcoming the situation where correct policies are made but ineffective implementation. Regarding the fight against counterfeit goods, what the people and businesses are waiting for is not more slogans, but concrete changes: counterfeit goods being pushed back, the market becoming more transparent, and consumers being better protected.
To make the fight against counterfeit goods more effective, many experts believe that consumers should be placed at the center. Protecting consumer rights is not just about punishing violations, but also about providing complete information, enhancing self-protection capabilities, and creating conditions for consumers to participate in market monitoring. In that case, counterfeit goods will have little chance of thriving.
It's time for counterfeit goods to be dealt with through a coordinated institutional framework, strong laws, and concrete action. When the law is implemented, discipline is tightened through strict legislation and consistent action, the market will truly become a safe space for citizens and businesses, creating momentum for sustainable development.
