After receiving the supplementary investigation report and case file of Dang Thi Han Ni (46 years old - lawyer, journalist) and lawyer Tran Van Sy (66 years old) for "abusing democratic freedoms to infringe upon the interests of the state, the legitimate rights and interests of organizations and individuals," the Ho Chi Minh City People's Procuracy has returned the case file for the second time, requesting the Ho Chi Minh City Police Investigation Agency to further clarify several issues.
The defendant, Dang Thi Han Ni (on the right), has been charged with insulting the dignity, honor, and reputation of Mrs. Nguyen Phuong Hang and her husband.
According to the case details, from September 2021 to February 2022, defendant Tran Van Sy used the YouTube account "LS Tran Van Sy"; Dang Thi Han Ni used the YouTube and Facebook accounts "Nha Bao Han Ni" to post articles and organize numerous video recordings broadcast on social media containing false information, aiming to insult the dignity, honor, and reputation of Mr. Huynh Uy Dung (61 years old, Chairman of the Board of Directors of Dai Nam Joint Stock Company) and his wife, Ms. Nguyen Phuong Hang (52 years old, General Director of Dai Nam Joint Stock Company), and infringe upon the legitimate interests of Dai Nam Joint Stock Company ( Binh Duong ) and the Hang Huu Charity Fund.
In July 2023, the Ho Chi Minh City Police concluded their investigation into this case. Subsequently, the Ho Chi Minh City People's Procuracy returned the file, requesting further investigation into several aspects, such as recording statements from Mr. Huynh Uy Dung and Ms. Nguyen Phuong Hang (who were recently sentenced to 3 years in prison by the Ho Chi Minh City People's Court for abusing democratic freedoms to infringe upon the interests of the state and the legitimate rights and interests of organizations and individuals - PV) to clarify the claim for compensation; and clarifying the causes, motives, methods, tools, means, time, location, and sequence of the criminal acts of defendants Dang Thi Han Ni and Tran Van Sy.
In October 2023, the Ho Chi Minh City Police Investigation Agency completed the supplementary investigation report on the case.
The Han Ni case: Is it feasible for Ms. Nguyen Phuong Hang to demand 500 billion VND in compensation?
The supplementary investigation concluded that, during questioning, the defendant Dang Thi Han Ni admitted that the reason for her statements regarding Ms. Nguyen Phuong Hang was because Ms. Hang had made insulting remarks about Han Ni during a live online post on September 3, 2021.
Therefore, on September 3, 2021, Dang Thi Han Ni recorded and posted online with the title: "Does Ms. Hang have the right to trample on the law?" to refute Ms. Hang's inaccurate statements about the defendant Han Ni "extorting businesses," "being the mistress of Mr. Tat Thanh Cang," "insulting the Minister of Information and Communications," posting images of Han Ni "insulting the Minister," and posting images of Han Ni and her ex-husband on social media to call them "prostitutes" and "reactionaries."
Regarding the criminal conduct of defendant Tran Van Sy, the investigation conclusion states that in the 8 video recordings posted on August 15, 2021, August 29, 2021, September 5, 2021, September 10, 2021, September 19, 2021, September 24, 2021, September 28, 2021, and October 16, 2021, this defendant disseminated false information causing public panic, infringing upon the legitimate rights and interests of Dai Nam Joint Stock Company; disseminated fabricated and false content infringing upon the honor, reputation, and dignity of Mr. Huynh Uy Dung; and disseminated content that seriously insulted the honor, dignity, reputation, and dignity of defendant Nguyen Phuong Hang...
Ms. Nguyen Phuong Hang is demanding 500 billion VND in compensation.
According to the supplementary investigation report, based on the statements taken from Mr. Huynh Uy Dung and Ms. Nguyen Phuong Hang, Mr. Dung requested that the investigating agency handle the case in accordance with the law against the defendant Dang Thi Han Ni for making fabricated and false statements that infringed upon the honor, reputation, and dignity of Mr. Dung and Ms. Hang.
Ms. Hang requested that the investigating agency handle the case in accordance with the law against Ms. Dang Thi Han Ni for making defamatory and slanderous statements against Ms. Hang, Mr. Dung, Dai Nam Joint Stock Company, and Hang Huu Charity Fund.
According to Ms. Nguyen Phuong Hang, because these individuals insulted her honor and dignity, caused economic damage to Dai Nam Joint Stock Company, and severely damaged the reputation of the Hang Huu Charity Fund, she is demanding compensation of 300-500 billion VND to be deposited into the state treasury. To date, Mr. Dung and Ms. Hang have not provided documents proving the material and emotional damages.
