Mr. Duong is a man passionate about lottery games and plays according to his own principles. The amount of money he spends on lottery tickets is a very small fraction of his total monthly income. His mindset when playing the lottery is that if he wins, great, but if he loses, he will never regret it.

When he first started playing the lottery, Mr. Duong usually went to the lottery agent himself to buy tickets. Over time, Mr. Duong became a regular customer and befriended the owner of the agent, Mr. Tran.

Mr. Duong often asked Mr. Tran to buy lottery tickets for him via WeChat messaging. After the lottery agent successfully purchased the tickets, he would take a photo of the tickets for confirmation, and only then would Mr. Duong transfer the money.

Initially, their collaboration was quite pleasant. Whenever Mr. Yang won a small prize, Tran would collect it on his behalf and then return the prize money via WeChat.

However, their relationship soured after Yang discovered that he had simultaneously won two lottery prizes – one for the first prize and one for the third prize. The total prize money was 10 million yuan (35 billion VND). But this large sum of money had been taken by the couple who owned the lottery agency, Mr. and Mrs. Chen.

Witnessing the large prize money "vanish into thin air," Mr. Duong decided to sue the Tran couple. In court, as the plaintiff, Mr. Duong needed to prove that he had authorized Tran to buy the lottery tickets; otherwise, he would lose the case.

At this point, Mr. Yang produced the WeChat chat logs and transfer history to prove that he frequently asked Tran to buy lottery tickets for him.

Reportedly, after Mr. Duong called the police, the investigation revealed that the person who received the reward money was Ms. Hoang, Mr. Tran's wife.

However, Mr. Duong was unable to provide images and confirmation messages from Mr. Tran regarding the purchase of the winning lottery ticket. This is because Mr. Tran had set up automatic deletion of images and messages on WeChat.

In response to Mr. Duong's accusations, Mr. Tran simply replied, "I am not wrong." Mr. Tran's counter-argument was that Mr. Duong could not provide evidence proving that he was entrusted with the task of purchasing lottery tickets. Ultimately, Mr. Duong lost the first instance trial; not only did he fail to recover his money, but he also incurred legal fees for the case.

A lesson everyone needs to remember.

So, from a legal perspective, how can we view the dispute between Mr. Duong and Mr. Tran?

According to Article 919 of the Civil Code, a trust contract is an agreement whereby the trustee will handle the work of the trustee.

This means that if Mr. Duong can prove that he authorized Tran to buy the lottery ticket via WeChat, then Mr. Duong is the rightful owner of the winning ticket.

However, the factual detail in this case is that Duong could not prove that Tran had received a mandate to buy lottery tickets on his behalf, so in the end, he had to accept a complete loss. In other words, Duong lost the case because he did not retain any text messages proving that the two had a mandate relationship.

Mr. Duong's unfortunate loss of money serves as a lesson for everyone: don't ask others to buy lottery tickets for you, to avoid unnecessary trouble. Even if the person you entrust the task to is a close friend, it can still lead to you being scammed or cheated out of your money.

Online transactions, not just lottery ticket purchases, carry many risks, and even legal proceedings can be difficult to determine right from wrong if you don't retain evidence. In fact, Mr. Duong is not the only case of someone winning a prize but not receiving any money due to a dispute with the lottery ticket seller. In such cases, litigation not only wastes time and effort but also doesn't guarantee recovery of lost money.
