Mr. Duong is a man who is passionate about the lottery and plays by his own rules. The amount of money he spends on lottery tickets is a very small amount in his total monthly income. His mentality when playing the lottery is that if he wins, it is good, but if he loses, he will never regret it.

When he first started playing the lottery, Mr. Duong often went to the agency to buy lottery tickets himself. Over time, Mr. Duong became a regular customer and became close to the agency's owner, Mr. Tran.

Mr. Duong often asks Mr. Tran to buy lottery tickets through messaging on the WeChat application. After the agent successfully buys the lottery ticket, he will take a photo of the lottery ticket for confirmation, then Mr. Duong transfers the money.

At first, the cooperation between the two was quite pleasant. Whenever Mr. Duong won a small prize, Tran would go to receive the prize on behalf of the customer, then return the prize money via WeChat.

However, their relationship broke down after Mr. Duong discovered that he had bought two winning lottery tickets at the same time, winning first and third prizes. The total prize value was 10 million yuan (35 billion VND). But this large sum of money was taken by the lottery agency owner and his wife, Mr. Tran.

Seeing the large prize money "disappear", Mr. Duong determined to sue Tran and his wife in court. In court, as the plaintiff, Mr. Duong needs to prove that he authorized Tran to buy the lottery ticket, otherwise he will lose the case.

At this time, Mr. Duong took out the WeChat conversation record and transfer history to prove that he often asked Tran to buy lottery tickets for him.

It is known that after Mr. Duong called the police, the investigation results showed that the person who received the bonus was Ms. Hoang, Mr. Tran's wife.

However, Mr. Duong could not provide the photo and confirmation message from Mr. Tran about the purchase of the winning lottery ticket. Because Mr. Tran had set the mode to automatically delete photos and messages on WeChat.

In response to Mr. Duong's accusations, Mr. Tran simply replied: "I'm not wrong." Mr. Tran's rebuttal was that Mr. Duong could not provide evidence to prove that he was entrusted with the purchase of lottery tickets. In the end, Mr. Duong lost the first instance trial, not only did he not get his money back, but he also had to pay the case handling fee.

Lessons everyone needs to remember

So from a legal perspective, how can we view the dispute between Mr. Duong and Mr. Tran?

According to Article 919 of the Civil Code, a trust contract is a contract agreeing that the trustee will handle the work of the trustor.

This means that if Mr. Duong can prove that he authorized Tran to buy the lottery ticket through WeChat, then the legal owner of the winning lottery ticket is Mr. Duong.

However, the actual circumstances of this case were that Duong could not prove that Tran had received a mandate to buy lottery tickets for him, so in the end he had to accept the loss. In other words, Duong lost the case because he could not save the text messages proving that the two had a mandate relationship.

Mr. Duong’s unfortunate loss of money is a lesson for everyone not to ask others to buy lottery tickets, to avoid unnecessary trouble. Even if the person entrusted is a close friend, it can still lead to you being scammed or not getting paid.

Online transactions, not just lottery tickets, have many risks and it is difficult to judge right or wrong if you do not keep evidence. In fact, Mr. Duong is not the only case of winning a prize but not receiving any money because of a dispute with the lottery ticket seller. At that time, litigation not only wastes time and effort, but also makes it uncertain that you will be able to recover the lost money.
