On February 20th, the Hanoi People's Court issued a decision to bring to trial the case of violations of bidding regulations, involving former Chairwoman of AIC Company Nguyen Thi Thanh Nhan and several individuals at the Vietnam Computer Emergency Response Center (VNCERT) under the Ministry of Information and Communications.

According to the decision, all 13 defendants were prosecuted for violating bidding regulations causing serious consequences. In addition to Ms. Nhan, there is also defendant Nguyen Trong Duong, who at the time of the violations was the Director of VNCERT, and later held the position of Deputy Head of the Planning and Finance Department of the Ministry of Information and Communications.
The remaining defendants include: Ngo Quang Huy, former Deputy Director of VNCERT; Tran Duy Hieu, former Deputy Head of the Planning and Finance Department; Nguyen Huy Hung, specialist in the Planning and Finance Department; Tran Nguyen Chung, former Head of Department under the Information Security Agency; Nguyen Thi Anh Hong, specialist at VNCERT...
The trial is scheduled to begin on March 17th and last for eight days. The judging panel consists of three members, with Judge Luu Ngoc Canh presiding.
According to the indictment, in 2016, VNCERT was assigned by the Ministry of Information and Communications to implement a project to purchase equipment and hire technical services to monitor and analyze incidents and attacks on network security on several international internet connection channels. The total investment was 95 billion VND.
Right from the stage of compiling the equipment and software catalog, Ms. Nguyen Thi Thanh Nhan instructed her subordinates at AIC Company to contact suppliers, inquire about the prices of equipment according to VNCERT's catalog, add 40% to the estimated price, and include it in the project's feasibility study report.
VNCERT uses the above list and budget to formalize the consulting packages for the Planning and Finance Department to appraise and submit to the Ministry's leadership for approval.
When issuing the tender documents, Ms. Nhan instructed her subordinates to propose a financial contribution of 70 billion VND for AIC Company to participate in the bidding process, and simultaneously designated Mopha Joint Stock Company (part of the AIC ecosystem) as a "dummy bidder" to facilitate bid rigging.
Due to the actions of Ms. Nhan and the other defendants, state assets suffered losses exceeding 17 billion VND. To date, Ms. Nhan remains at large.
According to the indictment, Mr. Nguyen Trong Duong was the representative of the investor during the implementation of package number 8. He instructed his subordinates to facilitate AIC's participation and winning the bid.
After the bidding process, Mr. Duong received a Tet gift bag from AIC Company containing 1 billion VND. The defendant used 200 million VND for personal expenses, and the remainder was used to pay Tet bonuses to VNCERT employees participating in the project.
For Nguyen Thi Thanh Nhan, this is the fifth case in which the former Chairwoman of AIC Group has been prosecuted for criminal responsibility.
In late 2022, Ms. Nhan was sentenced to 30 years in prison for two crimes: violating bidding regulations causing serious consequences and bribery, in a case that occurred at Dong Nai Provincial General Hospital.
In October 2023, Ms. Nhan was sentenced to 10 years in prison in a case involving irregularities in the supply of equipment at the Quang Ninh Provincial Obstetrics and Pediatrics Hospital.
Ms. Nhan was also sentenced to 24 years in prison in the case involving the Ho Chi Minh City Biotechnology Center and 13 years in prison in the case of bribing the former secretary and former chairman of Bac Ninh province.
