Accordingly, the Ministry of Construction requires its Departments, Divisions, and affiliated units to seriously grasp the Party's policy on decentralization and delegation of power in the direction that the Government, Ministries, and ministerial-level agencies focus on macro-management, building institutions, strategies, planning, plans, mechanisms, and policies, playing a constructive role, and strengthening inspection and supervision.
Thorough decentralization in all areas
Local governments are thoroughly decentralized and delegated in all areas, ensuring proper implementation of the motto "locality decides, locality acts, locality is responsible".
Agencies and units, according to their assigned functions and tasks, urgently review all specialized laws, ordinances, resolutions, decrees, decisions of the Prime Minister , and circulars drafted, consulted and submitted by the agencies and units, and complete before May 19.
In which, specific statistics on the quantity and detailed content of the tasks and powers of the National Assembly , the National Assembly Standing Committee; the Government, the Prime Minister; Ministers, specialized agencies under the Ministry; Tasks and powers of the People's Council, People's Committee, and Chairman of the People's Committee at the district level are currently stipulated in specific articles, clauses, and points of current legal documents.
Along with that, the quantity and detailed content of regulations, procedures and processes that localities must report to and seek opinions from the Government, the Prime Minister, the Ministry of Construction, and ministries and branches on specific projects and tasks that have been decentralized and delegated are currently stipulated in specific articles, clauses and points of current legal documents.
Units are also required, based on the results of the review and statistics, to propose decentralization, delegation of authority and division of authority of local governments according to the 2-level local government organization model.
In particular, 4 contents need to be clearly defined, including: Number, details of tasks, authority of the National Assembly, the National Assembly Standing Committee, and delegation of authority to the Government, Prime Minister and local authorities.
Number and details of tasks and authorities of the Government and Prime Minister decentralizing and delegating powers to Ministers, Heads of ministerial-level agencies and local authorities.
Number and details of tasks and authorities of Ministers and Heads of ministerial-level agencies (including tasks and authorities of specialized agencies under the Ministry) decentralized and delegated to local authorities.
Number and details of tasks and powers of People's Council, People's Committee, Chairman of People's Committee at district level transferred to People's Council, People's Committee, Chairman of People's Committee at commune level; tasks transferred to People's Council, People's Committee, Chairman of People's Committee at provincial level.
"Agencies and units must clearly explain the reasons, legal basis, and practical basis for: tasks and authorities that are not proposed for decentralization; tasks and authorities of district-level local authorities transferred to provincial-level local authorities," the dispatch stated.
At the same time as May 19, the assigned units will propose specific additional content to the draft Decrees and Circulars on decentralization, delegation, and division of authority in the fields of construction and transportation that the Ministry is drafting. In the case of specific and specialized fields, agencies and units can propose to develop separate decrees to promote decentralization and delegation of authority in State management of these fields.
To ensure effectiveness in performing assigned specialized management functions and tasks, the Ministry of Construction also requires that before May 23, units review and advise the Ministry to issue guiding documents according to their authority to handle problems and issues arising in their management areas when implementing the arrangement of administrative units at all levels and organizing the implementation of 2-level local government.
In particular, handling the contents and tasks that need to be transferred when arranging provincial-level administrative units, eliminating the district level, and implementing the organization of two-level local governments to ensure that local governments operate continuously, without interruption, and serve people and businesses well.
