Expedite the issuance of land ownership certificates to citizens.

Explaining the delay in issuing land ownership certificates, the Ho Chi Minh City Land Registration Office stated that the delay was due to both objective and subjective reasons, but primarily subjective ones.

For example, regarding coordination with tax authorities, the processing time for applications by the Ho Chi Minh City Tax Department, including the time taken to return applications requiring corrections, is often delayed compared to the stipulated time. Many cases require additional documents that do not comply with the regulations in Joint Circular No. 88. Furthermore, the Ho Chi Minh City Tax Department has to verify the purchase and sale prices for the majority of transfer applications, leading to frequent delays in processing applications at the branch offices of the Land Registration Office.

The Ho Chi Minh City Land Registration Office also noted that coordination with commune-level People's Committees and specialized agencies under district-level People's Committees is still lacking. Most cases of first-time land title registration involve legal complications (unclear documents, unclear land ownership, transactions conducted via handwritten agreements, inheritance involving foreign elements, unauthorized or illegal changes to the property's current state), thus the research, processing, and verification of files take a considerable amount of time.

Land ownership certificates are issued at the Thu Duc City Branch of the Land Registration Office.

Some People's Committees of wards and communes, as well as specialized departments, have been slow in responding to verification requests regarding the origin and planning information, lacking necessary verification documents, thus delaying the process of submitting for appraisal and signing of land ownership certificates. Many cases have not been updated according to the VN-2000 coordinate system, leading to overlapping boundaries, land encroachment, and incorrect locations in the cadastral database, requiring coordination between units to resolve.

Another obstacle causing delays in issuing land ownership certificates is the current tax integration software, meaning the connection between the specialized land management software and the Ho Chi Minh City Tax Department is not yet seamless. In many cases, the information declared by citizens on tax returns is incomplete, and when the Land Registration Office branches forward the information to the Ho Chi Minh City Tax Department, it is returned requesting additional information, leading to delays. In some cases, data transmission errors occur, requiring simultaneous processing and technical corrections, further impacting the processing time.

In addition, there are some subjective reasons, such as the one-stop service department receiving and returning results incorrectly following the procedures. For example, applications for registration changes or new issuance, which should take 15 working days, are mistakenly processed as renewals within 7 working days, leading to statistics showing delays by procedure type. Some officials and employees also have limited legal knowledge and make incorrect judgments…

In response to the aforementioned delays, Mr. Nguyen Toan Thang, Director of the Ho Chi Minh City Department of Natural Resources and Environment, instructed the branches of the Land Registration Office with overdue applications to quickly analyze the causes and find solutions to rectify the situation in the remaining quarters. Issues within the department's jurisdiction should be addressed immediately, while those outside the department's authority should be reported to and submitted to the Ho Chi Minh City People's Committee for guidance and coordination between districts, Thu Duc City, and other departments in the process of issuing land ownership certificates to citizens.

While there is a coordination mechanism in place between the tax authorities and the branches of the Land Registration Office, many shortcomings remain. Therefore, the Ho Chi Minh City Department of Natural Resources and Environment will soon report to the Ho Chi Minh City People's Committee leadership to address these existing problems. Only through such decisive action can the 98% on-time processing rate targeted by the Ho Chi Minh City People's Committee be achieved.
