Many shortcomings and limitations exist.
Conducting an inspection on the conformity of wind power plant projects with the national power development plan for the period 2021-2030, with a vision to 2050; and determining the completeness and appropriateness of the process and procedures for inviting expressions of interest and approving investors for 14 wind power plant projects (in the former Quang Tri province) compared to the legal regulations in effect at the time of implementation, the Provincial Inspectorate pointed out many shortcomings and limitations in the investor selection process.
Specifically, in the process of selecting investors, the specialized agencies advising on this matter, namely the Department of Finance (formerly the Department of Planning and Investment) and the Department of Industry and Trade, failed to inspect, review, and update certain contents regarding: "List of works and projects requiring land acquisition approved by competent authorities," and "Detailed planning or zoning plan at a scale of 1/2,000 approved by competent authorities."
These are the grounds for approving expressions of interest (IUs), and also the conditions for investment projects using land as stipulated by investment and land laws, to be implemented according to the legally prescribed procedures. This leads to a process that does not ensure compliance with the law on approving IUs.

The Department of Industry and Trade chaired the preparation of the bidding documents with criteria that did not comply with regulations, specifically the criterion "Preliminary evaluation criteria on investor experience" for 10 projects after the effective date of Government Decree No. 225/2025/ND-CP on amending and supplementing a number of articles of decrees detailing some articles and measures for implementing the Law on Bidding on investor selection, which is inconsistent with the provisions of Decree No. 225/2025/ND-CP.
Advising the Provincial People's Committee to approve the land acquisition dossier without ensuring all the conditions stipulated by law, including the "List of works and projects requiring land acquisition approved by competent authority" and the "Detailed planning or zoning plan at a scale of 1/2,000 approved by competent authority," is inconsistent with the provisions of Clause 1, Article 39, Decree No. 115/2024/ND-CP of the Government on the preparation and approval of land acquisition dossiers.
Regarding this matter, the Department of Finance has also reviewed and advised the Provincial People's Committee to agree that including the criterion "Preliminary assessment criteria on investor experience" in the bidding documents for the Thai Duong 1 Wind Power Plant project is not in accordance with regulations.
Through an inspection of the content of the bid evaluation, appraisal, and approval process for investors, the Provincial Inspectorate discovered that the Bidding Expert Team, established under Decision No. 90/QD-SCT dated September 11, 2025, of the Department of Industry and Trade, failed to evaluate the "experience" criterion in the bid documents issued for many wind power plant projects. Furthermore, the unit violated the bidding time regulations for one wind power plant project by opening bids two hours after the deadline for submission and failing to report and seek guidance from the competent authority on how to handle the situation.
Solutions
According to the Provincial Inspectorate's assessment, despite the aforementioned procedural shortcomings, the inspection and review results show that all inspected projects are consistent with the approved Power Plan VIII, the regional plan, and the revised Quang Tri Provincial plan. This is the most important prerequisite for implementing energy projects. The Provincial People's Council has issued resolutions approving the list of land plots for bidding to select investors for all 14 projects, providing the basis for the Provincial People's Committee to approve the investment policy.
Eleven out of fourteen projects are located in the former Huong Hoa district, an area with particularly difficult socio -economic conditions. On December 11, 2025, the National Assembly issued Resolution No. 254/2025/QH15 (effective January 15, 2026) stipulating a number of mechanisms and policies to remove difficulties and obstacles in the implementation of the Land Law. Among these, energy projects in areas with particularly difficult socio-economic conditions are identified as cases where bidding for investor selection is not required for projects using land.
Currently, the Government is drafting a Decree to replace Decree No. 115/2024/ND-CP and Decree No. 225/2025/ND-CP. Accordingly, Clause 1, Article 39 of the draft does not include the content "List of works and projects requiring land acquisition approved by competent authorities for investment projects using land" as a basis for approving the bidding documents. This is a basis for consideration to resolve difficulties and obstacles in the investor selection process.
Regarding the inclusion of experience criteria in the bidding documents for 10 projects, which is inconsistent with the regulations in Decree No. 225/2025/ND-CP, after reviewing the files, the Provincial Inspectorate concluded that no violations of the prohibitions of the 2023 Bidding Law, as amended by Law No. 90/2025/QH15, were detected, and there was no basis to suspend the bidding or invalidate the investor selection results as prescribed. The Provincial Inspectorate also assessed that all selected investors met the capacity to implement the projects.
Based on the inspection results, the Provincial Inspectorate has made specific recommendations to accelerate the implementation of projects, avoiding waste of time and resources of the State and businesses, as well as investment opportunities for the province.
Accordingly, the Provincial Inspectorate recommended that the Provincial People's Committee direct relevant departments, agencies, and localities to fulfill their assigned functions and duties to guide investors in completing procedures and implementing projects on schedule. At the same time, it requested relevant agencies to carefully study new legal regulations, mechanisms, and policies that are appropriate to the practical situation, thereby creating conditions for investors to implement projects in accordance with investment laws and related legal regulations. Investors should actively and proactively cooperate with departments, agencies, and localities to complete projects on schedule and in accordance with the law.
