The Ministry of Home Affairs proposes to decentralize to the Provincial People's Committee the decision to select commune-level localities in the province to specifically apply the regional minimum wage.
Specifically, in the draft, the Ministry of Home Affairs proposed that the Government decentralize to the Provincial People's Committee the decision to select commune-level localities in the province to specifically apply the regional minimum wage according to the provisions of Decree 74/2024/ND-CP dated June 30, 2024 of the Government regulating the minimum wage for employees working under labor contracts.
Regarding the task of state management of local government, in the draft, the Ministry of Home Affairs proposes that the Prime Minister decentralize the Minister of Home Affairs to decide on the establishment of a Council to appraise dossiers on establishment, dissolution, merger, division, and adjustment of administrative boundaries of provincial-level units; the Chairman of the Provincial People's Committee decides on the recognition of island communes and safe zone communes.
In addition, the Ministry of Home Affairs proposed to amend Clauses 2 and 3, Article 3 of Decree 74/2024/ND-CP dated June 30, 2024 of the Government regulating the minimum wage for employees working under labor contracts.
According to the draft, the list of regions I, II, III and IV is as follows :
Region I and Region II, including: communes and wards of Hanoi City.
Region I, Region II and Region III, including: communes and wards of Ho Chi Minh City and Hai Phong City.
Region II, Region III and Region IV include: communes and wards in the provinces of Bac Ninh, Ninh Binh, Hung Yen, Phu Tho, Lao Cai, Thai Nguyen, Thanh Hoa, Nghe An, Quang Tri, Khanh Hoa, Lam Dong, Vinh Long, Dong Thap, An Giang, Ca Mau and the cities of Hue, Da Nang, Can Tho.
Region I, region II, region III and region IV, including: communes and wards in the provinces of Quang Ninh, Dong Nai and Tay Ninh.
Region III and Region IV, including: communes and wards in the provinces of Tuyen Quang, Cao Bang, Dien Bien, Lai Chau, Son La, Lang Son, Ha Tinh, Quang Ngai, Gia Lai, Dak Lak.
The draft clearly states that the People's Committee at the provincial level shall, based on the specific socio-economic conditions of each commune and ward, select and decide to apply a specific regional minimum wage for each commune and ward; ensuring that the minimum wage in the locality of the grassroots administrative unit is not lower than the minimum wage corresponding to the locality prescribed annually by the Government.
The draft also proposes to abolish the Appendix issued with Decree No. 74/2024/ND-CP dated June 30, 2024 of the Government regulating the minimum wage for employees working under labor contracts.
Decree No. 74/2024/ND-CP stipulates the minimum monthly wage and minimum hourly wage for employees working for employers by region as follows:

Also regarding the task of state management of labor, wages and social insurance, the draft proposes that the Chairman of the People's Committee at the commune level has the authority to receive:
- Report of the labor leasing enterprise as prescribed in Article 56 of the Labor Code.
- Collective labor agreement of the enterprise as prescribed in Clause 6, Article 56 of the Labor Code.
- Receive notice of temporary closure of the workplace as prescribed in Article 205 of the Labor Code.
