
The Ministry of Interior proposes decentralizing authority to provincial People's Committees to decide on the specific locations of communes within their provinces where regional minimum wage levels will be applied.
Specifically, in the draft, the Ministry of Interior proposes that the Government delegate to the Provincial People's Committees the authority to decide on the selection of communes within the province to apply the specific regional minimum wage as stipulated in Government Decree 74/2024/ND-CP dated June 30, 2024, which regulates the minimum wage for employees working under labor contracts.
Regarding the state management responsibilities for local government, the draft proposes that the Prime Minister delegate to the Minister of Interior the authority to decide on the establishment of the Council for appraising dossiers on the establishment, dissolution, merger, division, and adjustment of administrative boundaries of provincial-level administrative units; and the Chairman of the Provincial People's Committee decide on the recognition of island communes and safe zone communes.
In addition, the Ministry of Interior proposes amending Clauses 2 and 3 of Article 3 of Government Decree 74/2024/ND-CP dated June 30, 2024, which stipulates the minimum wage for employees working under labor contracts.
According to the draft, the list of geographical areas for Region I, Region II, Region III, and Region IV is as follows :
Regions I and II comprise the communes and wards of Hanoi City.
Regions I, II, and III comprise the communes and wards of Ho Chi Minh City and Hai Phong City.
Regions II, III, and IV include: communes and wards in the provinces of Bac Ninh, Ninh Binh, Hung Yen, Phu Tho, Lao Cai, Thai Nguyen, Thanh Hoa, Nghe An, Quang Tri, Khanh Hoa, Lam Dong, Vinh Long, Dong Thap, An Giang, Ca Mau, and the cities of Hue, Da Nang, and Can Tho.
Regions I, II, III, and IV comprise communes and wards in the provinces of Quang Ninh, Dong Nai, and Tay Ninh.
Regions III and IV include: communes and wards in the provinces of Tuyen Quang, Cao Bang, Dien Bien, Lai Chau, Son La, Lang Son, Ha Tinh, Quang Ngai, Gia Lai, and Dak Lak.
The draft clearly states that provincial People's Committees, based on the specific socio-economic conditions of each commune and ward, shall select and decide on the specific minimum wage level to apply to each commune and ward according to the region; ensuring that the minimum wage in each administrative unit at the grassroots level is not lower than the minimum wage corresponding to that area as stipulated annually by the Government.
The draft also proposes abolishing the Appendix issued with Government Decree No. 74/2024/ND-CP dated June 30, 2024, which stipulates the minimum wage for employees working under labor contracts.
Decree No. 74/2024/ND-CP stipulates the minimum monthly wage and minimum hourly wage for employees working for employers in different regions as follows:

Regarding the state management responsibilities for labor, wages, and social insurance, the draft proposes that the Chairman of the People's Committee at the commune level have the authority to receive:
- Reports from labor leasing companies as stipulated in Article 56 of the Labor Code.
- The enterprise's collective labor agreement as stipulated in Clause 6, Article 56 of the Labor Code.
- Receive notice of temporary workplace closure as stipulated in Article 205 of the Labor Code.
