Proposal on the number of Vice Chairmen of Provincial People's Councils after the merger

The Ministry of Home Affairs proposes that for cities merging or consolidating 3 provincial-level administrative units, there will be no more than 4 Vice Chairmen of the People's Council; for cities merging or consolidating 2 provincial-level administrative units, there will be no more than 3 Vice Chairmen of the People's Council. Provinces implementing mergers or consolidations will arrange no more than 3 Vice Chairmen of the People's Council.

The Ministry of Justice is reviewing the Draft Resolution of the National Assembly Standing Committee specifying the number of Vice Chairmen of the People's Council, Deputy Heads of the People's Councils at the provincial and communal levels and the arrangement of full-time delegates of the People's Councils at the provincial and communal levels.

The Draft Resolution was chaired by the Ministry of Home Affairs with 4 chapters and 11 articles.

According to the draft Resolution, the Provincial People's Council can arrange full-time delegates for the positions of Chairman of the People's Council, Head of the People's Council Committee and Member of the People's Council Committee; the Commune People's Council can arrange full-time positions for the Chairman and Head of the People's Council Committee. The Vice Chairman of the People's Council and Vice Head of the People's Council Committee at the provincial and commune levels are all full-time People's Council delegates.

Maximum of 4 Vice Chairmen of Provincial People's Council

Regarding the number of Vice Chairmen of the Provincial People's Council, the draft Resolution stipulates: For provinces and cities that merge or consolidate, cities that merge or consolidate 3 provincial-level administrative units have no more than 4 Vice Chairmen of the People's Council; cities that merge or consolidate 2 provincial-level administrative units have no more than 3 Vice Chairmen of the People's Council. In case of provinces that merge or consolidate, there are no more than 3 Vice Chairmen of the People's Council.

In provinces and cities that do not merge or consolidate, the number of Vice Chairmen of the Provincial People's Council shall not exceed two. In case the Chairman of the People's Council is appointed as a full-time delegate, the number of Vice Chairmen shall be reduced by one.

Regarding the number of Deputy Heads of the Provincial People's Council, for provinces and cities that merge or consolidate 3 administrative units, there will be a maximum of 4 Deputy Heads; for merging or consolidating 2 administrative units, there will be a maximum of 3 Deputy Heads.

In case the Ethnic Committee is established on the basis of the existing Ethnic Committees of 3 provinces and cities before the merger or consolidation, there will be no more than 4 Deputy Heads of the Committee; In case the Ethnic Committee is established on the basis of the existing Ethnic Committees of 2 provinces and cities before the merger or consolidation, there will be no more than 3 Deputy Heads of the Committee; In case the Ethnic Committee is established on the basis of the existing Ethnic Committee of one province or city before the merger or consolidation, there will be no more than 2 Deputy Heads of the Committee.

For provinces and cities that do not merge or consolidate, each Board has no more than 2 Deputy Heads.

In case the Head of the Provincial People's Council is a full-time delegate, the number of Deputy Heads is reduced by one person.

Also according to the draft Resolution, each Committee of the Provincial People's Council has no more than one member who is a full-time People's Council delegate.

Each Committee of the People's Council at the commune level is assigned an average of 2 Vice Heads .

For the People's Council at the commune level, the draft Resolution stipulates that each People's Council at the commune level has one Vice Chairman. Each committee of the People's Council at the commune level is calculated to have an average of 2 Vice Heads. Based on the natural area, population size, administrative unit classification, urban classification, socio-economic situation and orientation of the Standing Committee of the Provincial Party Committee, City Party Committee, the Standing Committee of the People's Council at the provincial level will decide on the specific number. However, the total number of Vice Heads of the People's Council at the commune level must not exceed the prescribed average frame.

The number of Vice Chairmen of the People's Council, Deputy Heads of the People's Council Committees and Members of the Committees of the Hanoi People's Council who are full-time People's Council delegates shall be implemented according to the provisions of the Law on the Capital.

According to the Ministry of Home Affairs, the drafting of the Resolution aims to concretize the 2013 Constitution (amended and supplemented by a number of articles in Resolution No. 203/2025/QH15) and the Law on Organization of Local Government No. 72/2025/QH15; improve the efficiency, effectiveness and efficiency of the People's Councils at the provincial and communal levels in the context of implementing the 2-level local government model and strengthening decentralization and delegation to local governments at all levels.

To implement the Party's policy and regulations in Clause 6, Article 54 of the Law on Organization of Local Government No. 72/2025/QH15, the draft Resolution stipulates:

- In provincial-level administrative units formed after the reorganization due to the implementation of consolidation and merger in 2025 according to the Resolution of the National Assembly, if the number of Vice Chairmen of the People's Council and Deputy Heads of the Provincial People's Council at the end of the 2021-2026 term is more than the number prescribed in this Resolution, then in the 2026-2031 term, the number of Vice Chairmen of the People's Council and Deputy Heads of the Provincial People's Council shall remain the same as at the end of the 2021-2026 term;

- From 2031, the number of Vice Chairmen of the People's Council, Deputy Heads of the People's Council, provincial level implementing the above merger and consolidation shall comply with the provisions of this Resolution, unless otherwise stipulated by competent authorities.
