Daniel Moreno-Gama, 20, is facing federal charges following the April 10 attack on Sam Altman's home and OpenAI's San Francisco headquarters. The U.S. Department of Justice charges him with conspiracy to cause damage and destruction of property with explosives, as well as illegal possession of weapons. The maximum sentences for the two charges are 20 years and 10 years, respectively.

According to the indictment, Moreno-Gama drove from Texas to California with the intention of killing the OpenAI CEO. In the early hours of April 10th (US time), Moreno-Gama threw a Molotov cocktail at Altman's gate and then proceeded to OpenAI's headquarters. There, he smashed the building's windows with a chair, declaring, "I've come to burn this place down and kill anyone inside."

When arrested, San Francisco police seized incendiary devices, kerosene canisters, and lighters from Moreno-Gama. Notably, they found a three-part document titled "Your Final Warning."

In the opening section of the document, Moreno-Gama wrote that he was "trying to kill" Altman. The document also included a list of names and addresses of board members, executives of various AI companies, and their investors.

"If I were to incite others to murder and commit crimes, I would have to set an example and show that I am completely faithful to my message," Moreno-Gama said.

The second part is titled "A Few More Words on the Extinction of Humanity," in which Moreno-Gama discusses the risks AI poses to humanity. The third part is a letter addressed directly to Altman titled "To Sam Altman if You Survive," in which he writes that if the OpenAI CEO survives, it would be a sign from the gods to "atone."

On the same day, April 10th, Moreno-Gama also sent emails with a similar version of this document to individuals at his former university in Texas.

Moreno-Gama appears to be linked to the Pause AI movement, a group advocating for a pause in AI development due to concerns about the potential for human extinction. The attack occurred days after the New Yorker published a lengthy investigation into Altman and questioned his credibility. Altman later admitted to initially ignoring warnings that the article could put him in danger.
