Preventing crimes and violations in cyberspace and telecommunications

Recently, Tay Ninh voters recommended that the Ministry of Public Security and the Ministry of Information and Communications have more effective solutions to detect and handle information pages, social networking applications, and subscribers sending advertising messages and classified ads related to black credit, bank loans, and online loans that are not in accordance with the law. At the same time, the functional sector needs to have a mechanism to manage money lending services through network applications for organizations and individuals outside the banking system; and announce legal lending applications for people to know.

Regarding the above issue, the Ministry of Information and Communications responded that the Ministry has submitted to the Government for promulgation Decree No. 15/2020/ND-CP dated February 3, 2020, stipulating sanctions for administrative violations in the fields of post, telecommunications, radio frequencies, information technology and electronic transactions, which stipulates very strict measures to ensure the prevention of spam messages and scam messages; increasing the fine from VND 80 million to VND 100 million for the act of sending spam messages, sending advertising messages, making advertising phone calls to phone numbers on the no-advertisement list; fine up to VND 200 million for the act of not preventing or recovering subscriber numbers used to spread spam messages. In addition, the person is also forced to return or surrender the illegal profits gained from committing the violation; forced to recover the prefix number and telecommunications number warehouse.

Decree No. 14/2022/ND-CP dated January 27, 2022 of the Government amends and supplements a number of articles of Decree No. 15/2020/ND-CP, which amends and supplements the additional penalty of suspending the development of new subscribers applicable to violations of subscriber information management.

Depending on the severity of the violation, the development of new subscribers will be suspended from 1 month to 12 months. This is a very strict form of punishment for telecommunications enterprises. The regulation adds a form of punishment to recover subscribers who spread spam.

Recently, the Ministry of Information and Communications organized an inspection, discovered, handled and transferred to the police agency to propose criminal prosecution of many violators of spreading spam messages; buying and using SIM cards with pre-registered subscriber information; phone harassment...

To prevent and combat law violations and crimes in the current context of globalization and international integration, contributing to ensuring the stability and development of the country, the Ministry of Information and Communications said it will implement a number of solutions such as:

Closely monitor enterprises in implementing and overcoming shortcomings and violations in subscriber information management, complying with inspection and audit conclusions; focus on assessing, detecting signs of violations, conducting surprise inspections and strictly handling enterprises that continue to commit violations; use means, equipment and telecommunications infrastructure to scan, detect and arrest subjects using fake BTS stations to spread spam and scam messages; increase information and propaganda to people about methods and tricks of making fraudulent calls; measures to block spam and scam calls so that people know and proactively implement them.

Strengthen inspection and strictly handle cases of illegal advertising, not using personal names, debt collection calls, harassment, and fraud; strengthen inspection and handle businesses that do not apply measures to prevent spam calls and spam messages; carry out surprise inspections of compliance with the law on network information security and provision of information content services on mobile telecommunications networks for mobile telecommunications businesses.

Coordinate with relevant agencies and units to develop a set of criteria to identify spam calls to direct telecommunications enterprises to prevent them; direct enterprises to remind, rectify, and cut off harassing subscriber services.

Strengthen information and propaganda to people about methods and tricks of making fraudulent calls; measures to block spam calls and fraudulent calls so that people know and proactively implement them; strengthen law enforcement, promptly and resolutely handle violations, especially advertisements and classified ads related to black credit and acts of slander and defamation of organizations and individuals in cyberspace.

Strengthen the work of grasping the situation, proactively assessing the current situation and forecasting the development trends of violations of the law in the financial sector, "black credit" activities and acts of slander and defamation of organizations and individuals in cyberspace.

Credit and lending activities are under the state management of the State Bank of Vietnam according to Decree No. 16/2017/ND-CP; organizations with licenses issued by the State Bank of Vietnam are allowed to conduct credit activities. The Ministry of Information and Communications will continue to strengthen coordination with the State Bank of Vietnam and relevant ministries and branches to propagate crime prevention and control in general and "black credit" financial lending in particular on cyberspace.

The Ministry of Public Security also responded to the above petition of Tay Ninh voters. Accordingly, recently, on social networking sites, there have appeared many articles and videos advertising payment applications (apps), online money-making websites, and unlicensed financial transaction platforms of a fraudulent nature, causing confusion in public opinion.

At the same time, many "black credit" activities have appeared on cyberspace, commonly loan applications on smartphones, e-wallets, lending websites, financial support. This activity fully exploits applications, telecommunications services, advertising websites, social networking sites to promote, attract, guide and offer attractive policies to those in need.

To proactively prevent and combat the above situation, the Ministry of Public Security is continuing to direct the Public Security of units and localities to focus on implementing many solutions such as: Effectively organizing and implementing directives of the Party, State and Ministry of Public Security on the fight against crimes related to "black credit" activities, including Directive No. 12/CT-TTg dated April 25, 2019 of the Prime Minister on strengthening the prevention and combat against crimes and violations of the law related to "black credit" activities.

Strengthen the work of grasping the situation, methods and tricks of activities of all types of crimes related to applications and websites for making money online, binary options, gold, forex trading floors, organizations and individuals conducting illegal multi-level business activities nationwide; organize investigations, verifications, combats and strictly handle crimes and violations of the law, create deterrence and repel the activities of the above types of crimes; promptly receive and handle 100% of reports and denunciations of crimes related to "black credit" activities.

Improve the effectiveness of the movement for the entire people to protect national security; do a good job of propaganda and social prevention; create reports and articles to propagate and warn people about illegal acts related to loan apps, fraud and illegal online loan organizations, helping people to prevent and avoid being lured and enticed to participate and promptly report crimes.

Strengthen coordination in preventing and combating "black credit" crimes in cyberspace among ministries, branches, units and localities, especially in sharing information, coordinating verification, collecting information and documents to serve the fight against and handling of crimes; publicizing legal lending applications, and propagating to people to be careful when borrowing money online (need to research carefully before borrowing money through websites, apps...).

Review and detect loopholes and inadequacies in mechanisms, policies and laws to advise and propose the development and improvement of mechanisms, policies and laws, contributing to strict management and improving the effectiveness of state management in preventing and combating "black credit" activities through electronic websites.
