At approximately 1 PM on October 8, 2024, while Nguyen Van Sang (born in 1975, residing in Group 16) was using drugs, Nguyen Van Dung (born in 1971, residing in Group 15) brought a nylon bag containing 0.4859 grams of Methamphetamine and asked Sang to exchange it for Heroin, but Sang did not have any drugs. At this time, the police of Nui Sam Ward arrived to conduct an inspection, discovered the drugs, caught them red-handed, and seized the evidence.

At approximately 2 PM on October 8, 2024, the police of Nui Sam Ward (Chau Doc City) conducted an administrative inspection of house number 521/5, Group 16, Vinh Phuoc Hamlet. They discovered Sang hiding a transparent nylon bag containing white crystals weighing 0.7381g, suspected to be drugs, under a mattress. They also seized from Dung a transparent nylon bag containing white crystals weighing 0.4859g, suspected to be drugs, hidden under a fan. Sang confessed that the white crystals in the seized nylon bags were Methamphetamine purchased from Nguyen Van Sau (born in 1976, residing in Group 14, Vinh Phuoc Hamlet, Nui Sam Ward, Chau Doc City) for personal use. Therefore, the officers apprehended the suspect in the act of committing the crime and seized the evidence for investigation.

On October 21, 2024, Sang and Dung were charged and detained for further investigation, but were released on bail and prohibited from leaving their residence due to suffering from pulmonary tuberculosis. Following the initial investigation, on November 21, 2024, the Chau Doc City Police Investigation Agency executed an arrest warrant and searched the residence of Sau (at Group 14, Vinh Phuoc Hamlet, Nui Sam Ward), discovering and seizing 32 transparent nylon bags containing white crystals identified as Methamphetamine, with a total weight of 91.763 grams, and 23 transparent nylon bags containing white powder identified as Heroin, with a total weight of 49.772 grams.

Investigations revealed that between August and November 2024, Sau purchased methamphetamine and heroin four times from a person named Rot (whose identity and address are unknown) near his house. Three of these purchases were for 3 million VND each (2 million VND for methamphetamine and 1 million VND for heroin). After purchasing the drugs, Sau resold them to several other addicts (including Sang), earning nearly 5 million VND in profit. Additionally, Sau sold methamphetamine and heroin to approximately 4-5 other individuals whose names and addresses are unknown, each time for 400,000-500,000 VND. On November 19, 2024, Sau purchased another 22 million VND worth of methamphetamine and 15 million VND worth of heroin from Rot, which he then repackaged into several transparent nylon bags. However, he was arrested by the Chau Doc City Police Investigation Agency before he could sell them.

According to the trial panel, the actions of defendant Sau were particularly dangerous to society, constituting a particularly serious crime. The defendant illegally traded narcotics more than twice for profit, with the amount of narcotics seized during the arrest and search (from Sau and Sang, along with two other drug addicts) totaling 143.6758 grams. Regarding defendant Dung, he was a drug addict and had previously been subjected to administrative penalties, being sent to a compulsory rehabilitation center and completing his rehabilitation on April 16, 2024. After completing rehabilitation, Dung relapsed and continued to illegally use narcotics, being caught red-handed possessing 0.4859 grams of methamphetamine. Defendant Sang also illegally possessed 0.7381 grams of methamphetamine. The defendants' actions were dangerous to society and constituted a serious crime, therefore a severe punishment is necessary.

Based on the above findings, the Provincial People's Court sentenced defendant Sau to 20 years in prison for "Illegal trafficking of narcotics" under Point h, Clause 4, Article 251 of the Penal Code. Defendants Dung and Sang were sentenced to 2.5 years and 2 years in prison respectively for "Illegal possession of narcotics" under Point c, Clause 1, Article 249 of the Penal Code.
